The Office of the Ombudsman found probable cause to prosecute a
former House Representative and top officials of the Department
of Transportation and Communications (DOTC) for the ghost
purchase and delivery of 1,582 units of Nokia 1100 cellular
phones amounting to P6,248,900.00 in December 2004. Ombudsman Conchita Carpio Morales approved the filing of Informations for Malversation through Falsification and violation of Section 3(e) of Republic Act (R.A.) No. 3019 (Anti-Graft and Corrupt Practices Act) against former Iloilo 2nd District Representative Judy Syjuco and DOTC Bids and Awards Committee (BAC) Chairman Domingo Reyes, Jr., BAC Vice-Chairman Elmer Soneja and BAC members Director Rebecca Cacatian, Director Ildefonso Patdu, Jr., Legal Officer Geronimo Quintos and Director Venancio Santidad as well as DOTC Inspector Marcelo Desiderio, Jr., DOTC Technical Inspector Danilo Dela Rosa and private respondent Domingo Samuel Jonathan Ng, owner of West Island Beverages Distributor (West Island). The Office found that public respondents facilitated the release of public funds to Ng despite the fact that (1) there was no necessity of resorting to direct contracting instead of public bidding; (2) West Island did not present a certificate of exclusivity and was not an authorized supplier of cellular phones but a mere distributor of Smart Value Credits or Smartload per Marketing Distributorship Agreement; (3) the 1,582 cellular units never existed because they were never delivered; and (4) the Invoice Receipt for Property contained the lone name and signature of Santa Barbara, Iloilo Mayor Isabelo Maquino when the beneficiaries as appearing on several documents are the eight municipalities of the 2nd District of Iloilo. Ng acknowledged the receipt of payment net of taxes amounting to P5,964,859.00 while the Disbursement Voucher indicated that the cellular phones were for the “use of Hon. Judy Jalbuena Syjuco.” Records show that Ng is the President of Nation Bank, Inc. where respondent Judy Syjuco’s sons and Flame Property Holdings are stockholders. Respondent spouses Syjuco are stockholders of Flame Property Holdings. Ombudsman Morales stated that “the confluence of facts and evidence will show that respondents conspired with each other through seemingly separate but collaborative acts to defraud the government of P6,248,900.00.” She added that the Government Procurement Reform Act (R.A. No. 9184) and its implementing rules explicitly provide that public bidding is the rule and the alternative methods of procurement may be resorted only in highly exceptional cases. Investigation shows that then DOTC Secretary Leandro Mendoza received on 20 December 2004 a letter from ex-Representative Syjuco informing him that the Department of Budget and Management issued Special Allotment Release Orders (SARO) Nos. A-04-04117 and A-04-4969 in the total amount of P6,249,528.00 for the purchase of communications equipment for Region VI and requesting that the alternative method of procurement under R.A. No. 9184 be used to facilitate the acquisition. On 21 December 2004, Mendoza approved BAC Resolution No. 2004-84 recommending the purchase of communications equipment for Region VI through Direct Contracting. On 28 December 2004 through Resolution No. 2004-85, five (5) days after Ng submitted his quotation of P6,248,900.00 for 1,582 Nokia 1100 units, the contract was awarded to him. In addition to the criminal charges, public respondents Mendoza, Reyes, Soneja, Cacatian, Patdu, Quintos, Santidad, Desiderio and Dela Rosa were found administratively liable of Grave Misconduct and Serious Dishonesty and meted out the penalty of dismissal from the service with cancellation of eligibility, forfeiture of retirement benefits, perpetual disqualification from holding public office, and bar from taking civil service examinations. Meanwhile, by reason of his death, the criminal charges against Mendoza were dismissed. The administrative and criminal charges against former TESDA Director Augusto Syjuco were dismissed for insufficiency of evidence, while the administrative charges against Judy Syjuco were dismissed for lack of jurisdiction. |

Honda Cars Philippines, Inc. (HCPI) has announced a voluntary
safety recall of selected Honda Civic car models from 2003 and
2004 due to unusual/irregular deployment of the front passenger
airbags/supplemental restraint systems. The recall campaign, which is triggered by an incident in Japan, involves the replacement of the inflators of front passenger airbags of the said vehicles free of charge. However it is important to note that there has been no known or reported case of any unusual front passenger airbag deployment and/or injury caused by such in the Philippines. The Department of Trade and Industry (DTI) now offers the online
early renewal of business name registration as part of its
effort to provide an enabling environment for businesses to grow
in the country. “With this initiative, we intend to lower cost of doing business, save time, and avoid the long queues in DTI offices nationwide. Likewise, we promote a paperless environment in government,” DTI-Management Services Group (MSG) Undersecretary Nora K. Terrado said. Terrado said that to avail of this scheme, sole proprietors may log on to the Business Name Registration System’s (BNRS) website at bnrs.dti.gov.ph, and process the renewal of their business name registration three months before its expiration. Within this period, online updating of business profile is allowed and free of charge. In the old manual scheme, change of business name information is done through DTI tellers with a fee of P65, which includes P50 renewal fee and P15 documentary stamp tax per transaction. “With this online early renewal scheme in place together with the electronic payment (ePayment) facility using BancNet debit card or GCash, renewal transactions may now be processed through computers or mobile phones through the internet within 15 minutes, anytime, anywhere,” Terrado said. The following fees will be based on the scope of business name being applied for renewal: barangay, P200; city or municipality, P500; regional, P1,000; and national, P2,000. Change of business name scope will be in accordance to current validation rules. The Philippine National Police is now in the process of
delivering the sad news to surviving family members of policemen
slain in an encounter last Sunday with lawless elements in
Maguindanao. As a policy, the PNP withholds information about circumstances surrounding the death of a PNP member until the orphaned family has been notified. On Monday, the Philippine Flag was hoisted at half-mast at the PNP National Headquarters in Camp Crame as a sign of mourning over the loss of brothers in uniform. “I extend my deepest sympathy to the orphaned families of our fallen policemen. They died a meaningful death on the side of justice and righteousness. They did not die in vain,” PNP Officer-in-Charge, Deputy Director General Leonardo A Espina said. Despite the momentary setback of law enforcement operations against lawless elements in Mindanao, Espina expressed confidence that “justice and peace will prevail.” Meantime, the PNP is preparing the highest police honors to be given to the slain policemen, including all benefits due to the surviving kin. Surviving kin of slain policemen in Maguindanao encounter are entitled to receive death benefits ranging from P1.5-million to P2-million. Death benefits for policemen killed in line of duty include P250,000.00 from the President’s Social Fund; between P141,000.00 up to P181,000.00 as Special Financial Assistance (SFA) from the PNP; burial benefits worth P50,000.00; and P200,000.00 gratuity from the National Police Commission. PNP members of the Public Safety Mutual Benefit Fund are also entitled to death insurance ranging from P225,000.00 to P417,000.00 depending on rank. 23 January 2015 – On the 65th anniversary of the establishment
of diplomatic relations between the Philippines and the Hellenic
Republic, Foreign Affairs Secretary Albert F. del Rosario and
Greek Ambassador to the Philippines Constantina Koliou signed
today a Memorandum of Understanding (MOU) between the Philippine
Department of Foreign Affairs and the Greek Foreign Ministry on
the establishment of a mechanism for political consultations. Secretary Del Rosario noted that it was an auspicious start to the celebration of a milestone year. Diplomatic relations were established on 28 August 1950. The signing of the MOU caps the tour of duty to the Philippines of Ambassador Koliou. Secretary Del Rosario thanked the Ambassador for her special contribution in the strengthening of bilateral relations, particularly in the maritime and shipping sector. |

Senior Advisor on Climate Vulnerability, Mr. Robert D. Watkins,
called on Philippine Ambassador Cecilia B. Rebong at the
Philippine Mission office in Geneva on January 14 to convey to
the Philippine delegation the continuing commitment of the UNDP
to assist the Philippines as it begins its chairmanship of the
Climate Vulnerable Forum (CVF). The Philippines assumed the leadership of the CVF when the Philippines, through Climate Change Commission (CCC) Commissioner, Secretary Lucille Sering, accepted the offer of Costa Rica to be the next Chair of the CVF. The CVF is a block of countries from Asia, Africa and Americas that are vulnerable to the adverse effects of climate change. Its aims are sharing of good practices on adaptation, mitigation, sustainable development, financing, governance, low emission economic development, and other important fields linked to climate change policy. Ambassador Rebong said that the Philippine Mission in Geneva will work hand in hand with the UNDP in raising awareness on the negative effects of climate change and the important role that climate vulnerable countries play in climate change adaptation and mitigation measures. Ambassador Rebong also informed Mr Watkins that the Philippines, along with Bangladesh, is spearheading the preparations for the full day high level panel discussions on the adverse impact of climate change on the full and effective enjoyment of human rights during the March session of the UN Human Rights Council. Dr. Jaime C. Montoya, executive director of the Philippine
Center for Health Research and Development (PCHRD-DOST),
received the prestigious Career Executive Service award during
the Annual CES Conference held at the Waterfront Cebu City Hotel
in November last year. Dr. Montoya initiated the creation of the ASEAN-Network for Drugs, Diagnostics, and Vaccines Innovation (ASEAN-NDI) that enables R&D experts, government administrators and scientists in the region to work together to discover and develop health technologies that will address health problems and push forward the health industry among the ASEAN member states. Said health technologies include diagnostic tools, strategies, drugs, traditional medicine, vaccines and functional tools. In describing ASEAN-NDI’s purpose, the network’s official newsletter said that ASEAN-NDI is “meant to ensure that health technology development and the capacity of member states are appropriately maximized and managed according to regional health needs.” Dr. Montoya, in presenting the ASEAN-NDI initiatives, emphasized the “need to develop collaborative innovations on traditional medicine in addressing the escalating cost and poor access to modern medicine” which are current burdens in some ASEAN countries. Further, Dr. Montoya also pushed for the establishment of the Regional Health Research Development Consortia which empowers the regions to create their own research programs and formulate their own research activities. He also established the Philippine Health Research Ethics Board, the highest policy-making body for health research ethics in the country. The establishment of the ethics board guarantees the highest ethical practice in the conduct of health research in the country as the board sees to it that ethical guidelines on health research are constantly updated even as it oversees ethics review committees in human health research in the country. Dr. Montoya is also a member of the World Health Organization Western Pacific Region Clinical Advisory Committee for Emerging Infections. The search for 2013’s brightest public leaders is over as four Career Executive Service Officers (CESOs) were conferred the prestigious Gawad CES Award at the opening ceremony of the 13th Casino, November 12, 2014. about 49 hectares of agricultural lands in Amlan, Negros
Oriental to boost the economic condition of 20

Warrants of arrest issued vs. mother-daughter former bank officers for large-scale estafa, creation of fictitious loans | ||||||||||

A mother and her daughter who were former bank officers charged
with large-scale estafa continue to elude justice. Charged by the Department of Justice (DOJ) with 19 counts of large-scale estafa under Presidential Decree No. 1689 and 19 counts of creation of fictitious loans in violation of Section 21 (f)(5) of Republic Act 3591 or the amended Charter of the PDIC before the Regional Trial Court (RTC) of Guagua, Pampanga, Branch 51 were Sylvia R. de Castro and daughter Mary Jane C. Acol, former Assistant Manager and Corporate Secretary and shareholder, respectively, of the closed Rural Bank of Sta. Rita (Pampanga). The cases were based on a complaint by the Philippine Deposit Insurance Corporation (PDIC), Liquidator of RB Sta. Rita, after the conduct of preliminary investigation. Both mother and daughter have remained at large as police authorities in Pampanga have been unable to serve their warrants of arrest to date. PDIC is requesting the public's assistance for any information that may assist in the arrest of de Castro and Acol. Earlier, the DOJ has directed the Bureau of Immigration to issue a lookout bulletin against the accused to discourage them from leaving the country as well as to monitor their movements. The PDIC has requested the court to issue a Hold-Departure Order (HDO) against de Castro and Acol set for hearing on March 3, 2015. The criminal charges alleged that de Castro and Acol conspired, from February 2005 to August 2006, to misappropriate, convert and divert funds of RB of Sta. Rita by creating 19 fictitious loans totaling P5.96 million, through the falsification of commercial documents, and diverting P4.2 million worth of the proceeds of the fictitious loan accounts to Acol's personal bank account. The purported borrowers neither participated in the execution of the loan and commercial documents, nor received the loan proceeds of P4.2 million. The accused filed an Omnibus Motion to remand the cases to the DOJ for preliminary investigation, and recall previously issued warrants of arrest or defer the issuance of warrants of arrest. On October 13, 2014, the RTC denied the accused's Omnibus Motion and directed the issuance of warrants of arrest against both de Castro and Acol. PDIC is authorized to conduct investigations and file appropriate cases against erring bank officials and unscrupulous individuals. PDIC vigorously pursues legal action against erring bank officers, for the benefit of depositors/creditors and to protect the Deposit Insurance Fund (DIF), PDIC's funding source for payment of insured deposits. Commission on Audit (COA) Chairperson Maria Gracia M. Pulido Tan
is set to retire from her post as the Commission’s Chairperson
on February 2. Chairperson Pulido Tan told reporters who attended the launch of the second phase of the Citizen Participatory Audit project on January 22, 2015 that she would use her break from government service to relax. “No plans, I just want to relax, do all the things I missed doing while I was in the Commission, maglilinis ako ng bahay, mag-aalaga ako ng apo at magga-garden uli,” the Chairperson said. When asked if she received any offers for a different government post, the Chairperson was mum, saying she is not inclined to take another government position at this time but she hinted that she was not closing her doors either. “I’m not inclined to take a position at this time. It’s like when I came to COA, wala naman talaga akong balak, wala akong ambisyon. But things happen. I prayed about it and I came to the conclusion that this is probably what God wants me to do. I will be obedient. I leave it all up to God,” she said. Chairperson Pulido Tan said working with COAns was the biggest fulfilment of her career in COA. “It is my greatest fulfilment to lead this 9,000-strong organization. It was ground-breaking work. I did my best with the time I was given and it was enough. No regrets,” Chairperson Pulido Tan said. “Kung ano man ang naibahagi ko sa kanila, it is for them to utilize. COA and COAns will continue to work with fullest dedication in performance of their duties,” the Chairperson said when asked what legacy she will be leaving COA and its employees and officials. The feisty Chairperson led the special audit that uncovered anomalies and alleged misuse of lawmakers’ Priority Development Assistance Fund (PDAF) which eventually led to the Supreme Court decision striking down PDAF as unconstitutional. “Sa akin, trabaho lang. I was appointed to this position. I was confirmed by the legislature. I committed to do my best and it was part of the job. I had to do it. It had such great impact on governance, society and people. If that’s what people will remember me for, thank you,” Chairperson PulidoTan said. Asked about her possible successor, Chairperson Pulido Tan said it is up to the President, refusing even to speculate any possible candidates. “Hindi ko alam, that is the prerogative of the President,” Chairperson Pulido Tan told the reporters when asked if Budget Secretary Butch Abad or Bureau of Internal Revenue Commissioner Kim Henares will be the next COA Chairperson. - Dennis Cariño |

Four months after the government awarded the Operation and
Maintenance of LRT Line 1 Cavite Extension to the Light Rail
Manila Consortium, it has successfully issued its ninth (9th)
notice of award (NOA) for a Public-Private Partnership (PPP)
project last January 23. The Department of Transportation and Communications (DOTC) awarded the PhP 2.5 Billion (USD 55.56 Million) Southwest Terminal of the Integrated Transport System to MWM Terminals, a consortium of Megawide Construction Corp. and WM Property Management Inc. The DOTC invited bidders to submit bids to finance, design, construct, operate and maintain the Southwest ITS Project last December 27, 2013. Fifteen (15) bidders showed interest in the project during the bidding process. A year after, December 22, two bidders, Filinvest Land, Inc. and MWM Terminals, a consortium between Megawide Construction Corporation and WM Property Management, Inc. submitted their Qualification, Technical and Financial Documents for evaluation by the Project Bids and Awards Committee of the DOTC. On January 8 and 13, the bidders’ technical and financial bids were opened. During the bid opening, MWM Terminals offered a bid amount of P100 million as annual grantor payment (AGP) while Filinvest offered P650 million. This refers to the fee the government would pay annually in exchange for the facility and service to be provided by the concessionaire. The project was procured through a single-stage public bidding, ITS-Southwest project is part of the government’s goal to reduce vehicle volume and improve the traffic flow along Metro Manila’s major routes especially in EDSA. The ITS-Southwest Terminal to be constructed within a site area of 4.59 hectares outside the metro will serve passengers in the Cavite side. It will connect commuters to other transport modes such as the LRT/PNR, city buses, taxis, and other PUVs serving inner Metro Manila. It will include a passenger terminal building, emergency maintenance areas, arrival and departure bays, ticketing facilities, park-ride facilities, and transfer facilities such as shuttles to provide seamless transport connections. It has a concession period of 35 years inclusive of construction period. After the issuance of the NOA, the signing of concession agreement will follow. MWM Terminals have eight months after signing to start construction of the project. The Aquino administration has previously awarded eight PPP projects which include the NAIA Expressway, Daanghari-SLEX Link Road, PPP for School Infrastructure Project (PSIP) Phases I and II, Modernization of Philippine Orthopedic Center (MPOC), Automatic Fare Collection System (AFCS), Mactan-Cebu International Airport (MCIA) Passenger Terminal Building and the Operation and Maintenance of LRT Line 1 Cavite Extension. |

Department of Social Welfare and Development (DSWD) Secretary Corazon Juliano-Soliman said that the street families who were taken to Nasugbu, Batangas participated in the out-of-town activity for their inclusion in government programs, and not because they were being “hidden” during the Papal visit. “It was not for keeping them out of sight,” Sec. Soliman said. “We do reach out to families even before the announcement of the pope coming.” The MCCT orientation and registration family camp is conducted annually by the DSWD and its partner LGUs. This activity has been done in Aug 2011, Dec 2011, May 2012, and May 2014. Some 99 families or 427 individuals from Manila, Paranaque, and Pasay – particularly in areas along Roxas Boulevard to NAIA – attended the activity this year. “They will be registered in the Modified Conditional Cash Transfer Program for Homeless Street Families (MCCT-HSF) which provides a complete package of assistance to street families, including responsive shelter programs, with access to social services, and economic opportunities for the improvement of their living conditions,” Sec. Soliman said. Aside from the orientation on MCCT, activities during the five-day event were modular discussion on basic literacy and life skills enhancement for the adults and character building for the children. The adults also discussed topics such as understanding me as a person and as a parent, the difference between men and women, and family relations. The children, on the other hand, had a lecture and video presentation on personal hygiene, values caravan, and film showing. There were also recreational activities applying what they have learned from the activities. Not all street families were taken to Batangas. Many were still present along Taft and MH Del Pilar, Malate to see the Pope during his 5-day visit to the Philippines. “We cannot hide poverty. We cannot hide it from the pope, it’s here,” Sec. Soliman said. In the National Capital Region, some 2,479 families have already been registered in the MCCT-HSF since 2012. Sec. Soliman emphasized that the government’s aim “is to get the street dwellers off the streets, give them decent shelter and employment/livelihood opportunities to ensure that they are given a fighting chance.” “There are no legal means to get people off the streets, but we believe that majority of street dwellers will change their lives once provided with a little help. Mahalaga na maramdaman nila na tinatrato silang tao ng pamahalaan (It’s important that they feel that the government is treating them humanely),” Sec. Soliman ended. | ||||||||||
