Former Municipal Trial Court in Cities presiding judge Baguinda-Ali Pacalna faces a charge of Obstruction of Justice for taking custody of a prisoner without the order of a competent court.
Records show that in September 2007, police officers apprehended a certain Menor Saud who had a firearm in his possession and an outstanding warrant of arrest for carnapping issued by the Regional Trial Court of Lanao Del Sur. Saud was then arrested and detained at the Marawi City Jail. Judge Pacalna went to the city jail and took custody of Saud despite objection of the police officers.
The Ombudsman Resolution ruled that Judge Pacalna’s act was “laced with undue influence upon the jail warden to allow the unlawful release of a detainee” adding that “the release of a detention prisoner must be upon the order of a competent court, either through recognizance or by posting of a bond in any form allowed by law.”
Obstruction of Justice, as defined under Section 1(c) of Presidential Decree No. 1829, penalizes an individual who harbors, conceals, or facilitates the escape of any person whom he knows to have committed any offense under existing penal laws in order to prevent arrest, prosecution and conviction of the person in detention. |

The Civil Service Commission (CSC) has released the names of semi-finalists to the 2015 Search for Outstanding Public Officials and Employees and is asking the public to have a say in the judging.
Out of a total of 604 nominations nationwide, 33 went on to vie for the final round of screening, with those working in the fields of education and sciences dominating the slots.
The CSC urges the public to provide valuable information on any of the semi-finalists through the Honor Awards Program Secretariat not later than August 18, 2015 via hapsecretariat@gmail.com. Feedback gathered, whether positive or negative, will be used by the Search Committees in reevaluating the semi-finalists’ nominations to determine who will be given the awards.
There are three award categories. The Presidential Lingkod Bayan Award is conferred to an individual or group for exceptional or extraordinary contributions that had nationwide impact.

The National Police Commission (NAPOLCOM) confirmed the special meritorious promotion of the 29 personnel of the Philippine National Police (PNP) Special Action Force (SAF) for demonstrating acts of conspicuous courage and gallantry in action at the risk of their lives over and beyond the call of duty during an armed encounter on January 25, 2015 at Brgy. Tukanalipao, Mamasapano, Maguindanao.
This was announced by DILG Secretary and NAPOLCOM Chairman Mar Roxas after the Commission approved the promotion to the next higher rank of 29 SAF members following the recommendation made by then PNP Officer-In-Charge, Police Deputy Director General Leonardo A. Espina, for the grant of the special promotion.
NAPOLCOM Vice-Chairman and Executive Officer Eduardo U. Escueta said that the 29 operating personnel served the warrants of arrest against Zulkifli Bin Hir a.k.a. Marwan and Basit Usman in Tukanalipao, Mamasapano, Maguindanao where they encountered 700 fully armed men who were later identified as members of the Moro Islamic Liberation Front (MILF), Bangsamoro Islamic Freedom Fighters (BIFF) and private armed groups (PAGs) which resulted in the killing of 44 SAF Troopers and the wounding of 15 others. The operation resulted in the successful neutralization of Marwan.

Under Section 38 (b) of RA 6975, as amended by Section 33 (b) of RA 8551, any uniformed member of the PNP who has exhibited acts of conspicuous courage and gallantry at the risk of his/her life above and beyond the call of duty shall be promoted to the next higher rank, provided, that such acts shall be validated by the Commission based on established criteria. |

| The Department of Social Welfare and Development (DSWD) continues to assist the local government units (LGUs) affected by the Habagat or the Southwest Monsoon. As of August 11, 4PM, a total of 2,209 families or 10,025 persons from 18 barangays are affected where 566 families or 2,438 persons are inside three evacuation centers managed by LGUs of Negros Occidental, Bukidnon, and North Cotabato. The LGU of Kidapawan in North Cotabato provided P86,895 worth of food items, such as 20 sacks of rice, 15 boxes of sardines, 20 boxes of noodles, 15 boxes of corned beef, ½ sack of sugar, ½ sack of mongo, and ½ sack of dilis to 373 families or 1,865 persons affected by floods in Barangay Ilomabis. Likewise, the LGU of Sultan Kudarat distributed relief aid amounting to P63,750 to affected families. As heavy rains continue triggering more flooding incidents in the three provinces, concerned DSWD-Field Offices assured that relief supplies are enough to cover all affected LGUs. To date, DSWD-Field Offices VI, X, and XII have 75,181 family food packs prepositioned in their respective warehouses and ready to be delivered to LGUs when necessary |

The Department of Justice issued additional guidelines on the proper application of Article 125 on the crime of "Delay in the Delivery of Detained Persons to the Proper Judicial Authorities" of the Revised Penal Code, as amended.
Department Circular No. 50-A provides for the definition of the terms "detention" and "arrest" and clarifies that as a rule, the detention period begins at the moment of arrest.
"The protection of human rights especially of arrested and detained persons is a priority of the Department,” said Secretary of Justice Leila M. De Lima. “We continue to take proactive approaches through our Criminal Code Committee (CCC) issuances,” she said.
Current laws, guidelines, and jurisprudence do not explicitly state when the period of detention begins to run including those under custodial investigations in Republic Act No. 7438.
Assistant Secretary Geronimo L. Sy, Chair of the CCC said that "the added guidelines provide that the 12-18-36 periods are also applicable in custodial investigations.” The mandate of the CCC is to ensure due process of law in the criminal justice system. "Simplified and clear guidelines will translate into meaningful rule of law.”

Beginning August 10, 2015 (Monday), census enumerators wearing officially-issued ID card, bearing the signature of Dr. Lisa Grace S. Bersales, National Statistician and Civil Registrar General of the Philippine Statistics Authority (PSA), will visit every household and institutional living quarter (ILQ) in all barangays nationwide. About 90 thousand friendly enumerators (ENs) will ask basic information about the household members or ILQ residents, such as their age, sex, marital status, religious affiliation, highest educational attainment, and usual activity/occupation. The interview will take about 15 to 30 minutes.
The PSA is primarily responsible for the nationwide conduct of the 2015 Census of Population (POPCEN 2015), pursuant to Republic Act No. 10625 (Philippine Statistical Act of 2013). The main purpose of the mid-decade census is to update the population count in all barangays nationwide, in compliance with Executive Order No. 352 (Designation of Statistical Activities That Will Generate Critical Data for Decision-Making of the Government and the Private Sector).
The PSA needs the cooperation of the nation’s entire citizenry to ensure its success. Earlier, President Benigno S. Aquino III issued Proclamation No. 1031 declaring August 2015 as National Census Month. He called on the citizenry “to support and cooperate in the POPCEN 2015 by providing complete and correct information to census enumerators.” Section 25 of RA 10625 provides that “respondents of primary data collection activities such as censuses and sample surveys are obliged to give truthful and complete answers to statistical inquiries”.
All enumerators, team supervisors, census area supervisors, as well as PSA employees involved in the POPCEN 2015 are required to keep in strict confidence any information obtained during the census that pertains to any particular household or person. This is in accordance with Section 26 of R.A. No. 10625, which stipulates that “individual data furnished by a respondent to statistical inquiries, surveys, and censuses of the PSA shall be considered privileged information and as such shall be inadmissible as evidence in any proceeding”. The PSA will release data gathered from the undertaking only in the form of summaries or statistical tables. As such, no information about an individual or institution will be revealed.
Population counts by province, city/municipality, and barangay will be submitted to the Office of the President for proclamation as official for all purposes.

Labor and Employment Secretary Rosalinda Dimapilis-Baldoz yesterday congratulated six business establishments in Region 12 (SOCCSKSARGEN Region) for topping over several companies in winning the 2015 Regional Productivity Olympics of the National Wages and Productivity Commission (NWPC).
The six business establishments, namely, South Cotabato Integrated Port Services; Dole Philippines, Inc.; Dole Stanfilco Station 88; Dolefil Employees Cooperative Complex; Greentropics Coffee Enterprise; and Cinco Niñas Restaurant stand out as exemplars of productivity in their respective field. They will vie for the 2015 National Productivity Olympics Awards in October.
All of the regional Productivity Olympics winners received their trophies and cash prizes of P5,000 each from Secretary Baldoz during the 3rd Quarterly Meeting of the Regional Tripartite Industry Peace Council and Awarding of Region 12 Productivity Olympics Winners, Service Quality, Seal, and Livelihood held at the Sabrina Resort in Tambler, General Santos City. Baldoz, who was joined in the event by NWPC Executive Director Ma. Criselda Sy and DOLE Regional Office No. 12 Director Ofelia B. Domingo, was the keynote speaker at the event.
All of the six establishments have been issued Certificates of Compliance in both general labor standards and occupational safety and health standards. One winner, Cinco Niñas Restaurant, is also an awardee of the NWPC’s Service Quality Seal of Recognition.
“The Awards your received is very significant and valuable. And so, I sincerely congratulate you. It means you have successfully implemented and sustained your respective productivity improvement programs and practices resulting to more satisfied clients, harmonious labor-management relations, and increased profits, thus, enabling you to provide bigger incentives to your workers,” said Baldoz.
The regional phase of the 2015 Productivity Olympics was a battleground for Region 12’s micro, small, and medium enterprises (MSMEs) to showcase their businesses’ productivity journeys. It was also an opportunity for them to interact with other businesses, to give support, develop linkages and partnerships, and to learn from other companies on best practices.
The Awards categories are micro, small, and medium enterprises in agribusiness, service, and industry and winners were selected for Best Productivity Improvement Practices based on two criteria: (1) business excellence, which is composed of total productivity; expansion and growth; and awards/recognition/certification (50 percent); and (2) resource management, which is composed of people; systems, technology, and green productivity (50 percent).
“As winners, we recognize your accomplishments in productivity that had led to spectacular improvements and growth in labor and management relations, productivity performance, and human resource management,” said Baldoz.
The NWPC’s Productivity Olympics is a national competition of the best productivity practices of MSMEs. A biennial event, it is organized by the DOLE’s NWPC in coordination with the RTWPBs.
“The 2015 Productivity Olympics aims to intensify national awareness and commitment to quality and productivity by showcasing best productivity improvement practices among the countries MSMEs,” said Baldoz.
As a national competition, MSMEs duly registered with the appropriate government agencies, such as the DTI, SEC, CDA, and local government units can join the Productivity Olympics. Contenders must have a productivity program, existing for at least two years, preferably under the ISTIV program, and must have never been a recipient of the Productivity Olympics award at the national level.
For the 2015 Productivity Olympics, there is a regional screening committee to determine the regional winners composed of the RTWPB and an external quality and productivity champion in every region. For the national competition, there is a national screening committee which shall select the list of national finalists for submission to the National Judging Panel (NJP) chaired by the Secretary of Labor and Employment and composed of tripartite members. The national awarding will be held in October 2015 in time for the celebration of the National Quality and Productivity Month.
Winners in the 2015 Productivity Olympics can expect awards and incentives, such as the Productivity Olympics 2015 trophy and certificate; cash award; use of Productivity Olympics 2015 Award logo for publicity purposes for three (3) years, 2015-2017; and priority endorsement to other training programs and services of the NWPC/RTWPBs and other DOLE agencies.
“The Productivity Olympics is a relevant event that serves the purpose of giving due recognition to MSMEs and their owners’ and employees’ hard work to drive enterprise growth and productivity improvement,” said Baldoz, acknowledging that 99 percent of the country’s businesses are MSMEs and are the backbone of the economy in terms of employment-generation.
Also present during the event were the officials of the RTIPC Region 12, led by Jose Ronie V. Mondragon, Vice Chairperson for Labor, Engr. Arturo Zambrano, Vice Chairperson for Management, and the heads of the offices comprising the DOLE Regional Coordinating Council.

QUEZON CITY – The National Historical Commission of the Philippines (NHCP) will open the modernized Museo ni Manuel Quezon at the Quezon Memorial Shrine, Elliptical Road, Quezon City with His Excellency President Benigno S. Aquino III as the guest of honor on 19 August 2015 at 10:00 a.m. The date also marks the 137th Birth Anniversary of Manuel L. Quezon.
President Aquino, together with NHCP Chair Dr. Maria Serena I. Diokno, will lead the flag-raising and wreath-laying rites in honor of Manuel L. Quezon who served as the President of the Commonwealth of the Philippines from 1935 to 1944. H.E. Effie Ben-Matityau, Ambassador of Israel to the Philippines, will posthumously present the Raoul Wallenberg Medal to the descendants of Manuel L. Quezon in recognition of President Quezon’s implementation of an open door policy, which permitted one thousand two hundred Jews to migrate to the Philippines to escape the horrors of the Holocaust. Tour of the modernized museum follows.
The museum features the life and political career of President Quezon and the historical context in which he emerged as leader of the country. It also features a sizeable collection of President Quezon’s memorabilia, a hologram of the President delivering his inaugural address, and various interactive booths and terminals that show information about the Commonwealth period. The Museum also offers other facilities such as the audio-visual room, which presents a brief documentary about Quezon and the Museum; a gallery dedicated to Aurora Quezon and a re-creation of Manuel Quezon’s office as Commonwealth President.

Five (5) Agrarian Reform Communities (ARCs) in Nueva Vizcaya have benefitted from the recently conducted Basic and Upgrading skills training provided by the Department of Trade and Industry Region 02, through the initiative of the Comprehensive Agrarian Reform Program (DTI-CARP) on June 2015.
A total of 75 participants from the following ARC benefitted from the skills training: Villaverde Multipurpose Cooperative (Villaverde Cluster ARC) on the upgrading skills training on banana chips making held last June 9, 2015, Darapidap Auto Savings Group (DABECO ARC) on the basic skills training on tamarind wine making on June 10, 2015, Future life and Livelihood Association (FERMADA ARC) on the basic skills training on steamed rice cake making on June 18, 2015, Samahang Magsasaka ng Wacal, Inc., (Uddiawan ARC) on the upgrading skills training on bignay wine on June 24, 2015, and Bangaan Rural Workers Association (Uddiawan ARC) on the upgrading skills training on tamarind wine making held last June 25, 2015. All were conducted in Nueva Vizcaya.
For this June, the five ARCs contributed an amount of Php. 390,981 or 45.46 % of the total sales generated by all Nueva Vizcaya ARCs amounting to Php. 859,978.
Breakdown of sales generated by the five ARCs were as follows: Bangaan Rural Workers Association Php. 77,386, Samahang Magsasaka ng Wacal, Inc. Php. 31,112, Villaverde Multipurpose Cooperative Php 210,431, Future life and Livelihood Association Php. 39,872and Darapidap Auto Savings Group Php. 32,180.
In addition, 19 more jobs were generated.
Villaverde Multipurpose Cooperative Manager, Mr. Federico C. Mendoza lauded DTI for their continuous efforts in helping ARCs and striving SMEs further improve their way of life.

The Department of Trade and Industry (DTI)-XI launched three separate Negosyo Centers in Davao Region within 2nd week of July. Last July 6, the Negosyo Center in Davao Oriental opened while in July 9, similar facilities were launched in Davao del Sur and Davao City.
Negosyo Center is a one-stop shop for services intended to support existing and start – up small businesses. Its establishment is provided for in Republic Act No. 10644 (Go Negosyo Act) authored by Senator Paolo Benigno “Bam” Aquino IV, and was signed into law in July 15, 2014. It provides an array of services categorized into three major classifications, as follows: a) business registration assistance; b) business advisory; and, c) business information and advocacy.
For business registration, start-up businesses will be assisted in terms of information and facilitation of their registration documents and procedures for business name registration, business licensing and other regulatory permits. The Center will also be accepting and processing application for Barangay Micro Business Enterprises (BMBE) certificate, as soon as procedures and guidelines are finalized.
Business advisory consist of counseling services to guide MSMEs especially in the areas of financing access and financial management, product development, market promotion, and, investment promotion, among others.
Under Business Information and Advocacy, the Center will provide relevant business information such as economic, technical, market and investments-related info data and materials and facilitate related info campaigns in the form of trainings, seminars, briefings, and, dialogues.
DTI 11 OIC - Regional Director Maria Belenda Q. Ambi said the Negosyo Centers will also leverage on the collaboration of government agencies, local government units, financing institutions and business support organizations to consolidate and make accessible support programs and services to the MSMEs.
“Since the Negosyo Center is envisioned to be a one-stop-shop for micro and small entrepreneurs, it should be able manifest the convergence of programs and projects of all support institutions, both government and private. While the Center may not be able to host all these services, at least information will be made available and MSMEs will be guide,” she said.
In Davao Oriental, the Negosyo Center is located at the DTI-DO Provincial Office, 2F valles Building, Rizal Street, Mati City. In Davao del Sur, it is hosted by the Cor Jesu College of Digos, located at its main campus along Sacred Heart Avenue, Digos City.

To recognize the contributions?of farmers to communities and to the agricultural sector, Secretary of the Interior and Local Government Mar Roxas and the local government of Cebu will honor Filipino farmers as 'Heroes of the Land' during the Farmer's Day Celebration?on Wednesday?(Aug. 12).
Roxas believes that?local farmers should be lauded?for consistently providing food for various?communities, as their contribution to improving the lives of millions of Filipinos.
Under Daang Matuwid, the DILG has supported the agricultural sector through the construction of farm-to-market roads to ease the transport of farm goods, as well as?public markets where local commercial activities?happen.
When he was Secretary?of Trade and Industry (DTI) in?1999-2003,?he ensured that?prices of agricultural products in the market are fair and equitable?to protect the rights of both producing farmers and the consumers.
During his visit to Cebu, Roxas is also expected to attend the 62nd Philippine Sugar Technologists Association, Inc (PHILSUTECH) Annual National Convention to discuss the exemption of raw sugar from 12% Value Added Tax (VAT).
It was Roxas who helped facilitate the redefinition of raw cane sugar, in coordination with the
Bureau of Internal Revenue (BIR) under the Department of Finance (DOF), which was put on paper on?May 22nd.
Under the amendment, even more sugar products can be?considered as raw cane sugar—not just "muscovado."
The exemption of raw sugar from VAT seeks to incentivize activities undertaken by?sugar cane farmers, millers, distillers, traders, and suppliers in the industry across the country.
Roxas also believes that there is a need to?boost the agriculture sector in order to effectively execute a sustainable food security plan for the country in the?future.

In recognition of the right of indigenous peoples to culturally rooted and responsive basic education, the Department of Education (DepEd) adopted the Indigenous Peoples Education Curriculum Framework (DepEd Order No. 32, s. 2015) which aims to provide guidance to schools and other education programs as they engage with indigenous communities in contextualizing the K to 12 Curriculum based on their respective educational and social contexts.
The said framework is a fruit of a series of consultations with community elders, leaders and implementers of community-based Indigenous Peoples Education (IPEd) initiatives. As a major milestone in the enhancement of the IPEd Program, it will benefit more than 1.19-million IP learners enrolled in public schools, as well learners enrolled in community and civil society organization-run schools. In line with this, DepEd has started a training program for teachers and school heads in schools serving indigenous communities.
The design of a culturally-appropriate and responsive curriculum is anchored on the defining features of indigenous communities: the ancestral domain, the community’s worldview, and its indigenous cultural institutions. It includes and respects the community’s expression of spirituality and strengthens indigenous cultural identity. DepEd values indigenous languages in the implementation of a Mother Tongue-based Multilingual Education (MTB-MLE) among indigenous learners in order to regenerate and enrich the community’s Indigenous Knowledge Systems and Practices (IKSPs) and Indigenous Learning Systems (ILS). The curriculum is designed to enable indigenous learners to be future culture-bearers, capable of exercising their right to self-determination as they interact with other cultures.
The curriculum is open to the community’s teaching-learning processes complementing with that developed by DepEd. The commitment of culture bearers and IKSP holders to serve as knowledge managers in the teaching-learning process is recognized and their participation as appropriate is encouraged. DepEd recognizes that the ancestral domain where IKSPs are experienced, lived, and learned is the primary learning environment and learning space for indigenous learners. Community’s guidance shall be sought in designing learning activities involving places in the ancestral domain to maintain the wellbeing and sacredness of the area.
As instructional materials and other learning resources are vital to learners’ growth, they shall be developed and utilized in line with the indigenized curriculum content and teaching-learning processes. The content of these materials are not limited to artifacts, stories, dances, songs, musical instruments and the like. It is mother tongue-based and shall abide by the cultural standards and protocols agreed upon by DepEd and the community.
Classroom assessment shall be done utilizing tools adhering to the standards, competencies, skills and concepts being covered. Their design and use shall address the needs and concerns of the community and shall be developed with their participation.
The IPEd curriculum framework is guided by the principles of inclusion, participation, and empowerment as provided by DepEd’s National IPEd Policy Framework (DepEd Order No. 62, s. 2011 or “DO62”) and is consistent with the Indigenous Peoples Rights Act (IPRA) of 1997 and the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) which specify the right of IPs to “establish and control their educational systems and institutions”.
The meaningful participation of indigenous communities in the indigenization of the national curriculum shall be institutionalized through community engagement processes, mechanisms and activities mutually entered into by DepEd and the communities. |

Franco, holds the “4th PNP MOVE Summit” from August 12-13, 2015 in General Santos City.
Led by Sarangani Representative Hon. Emmanuel “Manny” D. Pacquiao, as guest of honor and speaker, the PNP MOVE Summit aims to wage an aggressive campaign towards eliminating violence against women.
“With the help of our Almighty God, problems become opportunities. Through the eyes of faith, we confront challenges with boldness and solve problems with wisdom” Congressman Pacquiao said during his speech on the said event.
“We will cause our awareness to propel us to action. We will cause our commitment to strengthen our resolve to do what is right” the Sarangani Representative added.
MOVE was launched through the initiative of the Philippine Commission on Women (PCW), formerly the National Commission on the Role of Filipino Women (NCRFW), on November 27, 2006 during the commemoration of the 18-Day Campaign to end VAW. It is an organization of principled men whose members have dedicated their time to be actively involved in eliminating all forms of violence against women (VAW).

MANILA – The Office of the Presidential Adviser on the Peace Process (OPAPP) said yesterday that it welcomes the submission by Sen. Ferdinand Marcos Jr. of his committee report on the Bangsamoro Basic Law (BBL) and expressed its readiness to extend any technical assistance to the Senate during plenary deliberations expected to start next Monday.
“We welcome the completion and submission by Senator Marcos of the committee report on the proposed BBL,” said OPAPP Sec. Teresita Quintos Deles, noting that her office is happy with this development because it will allow “plenary deliberations for the passage of the law to now proceed with all due diligence and without further delay.”
Deles added that the OPAPP expects the Senate to subject the bill to “rigorous scrutiny and debate,” especially as several senators have indicated their reservations regarding the substitute bill filed by Sen. Marcos. According to Deles, however, the OPAPP is always ready, just as before, to “extend any needed assistance to our lawmakers as they deliberate on the proposed bill.”
Deles noted that the OPAPP can help “explain and clarify the different provisions and their importance in addressing the aspirations of the Bangsamoro people” even before the plenary deliberations in the Senate, which are set to start on August 17.
Marcos will sponsor the bill which is now designated as the Basic Law for the Bangsamoro Autonomous Region or Senate Bill 2894 today, August 12.
The government’s chief negotiator in talks with the Moro Islamic Liberation Front (MILF), Prof. Miriam Coronel-Ferrer, also noted that the government panel welcomes the completion and submission to the Senate floor of Senator Marcos’ report.
She said this development in the Senate should spur progress in the efforts to pass the bill into a law also in the House of Representatives.
Plenary debates on the bill in the House are yet to resume after they were cut short when Congress went into recess last May. While regular sessions have resumed, quorum woes have plagued the lower house, stalling debates on the bill.
“Now that discussions on the BBL in the Senate are gaining momentum at last, we are also hopeful that members of the House will take this as a sign to continue working on their own deliberations regarding the bill,” Ferrer said. The chief negotiator also reiterated that both parties in the peace process continue to respect the wisdom of Congress and its power to enact legislation, but expressed hope for the passage of “a meaningful BBL that is faithful to the Comprehensive Agreement and will truly improve the lives of the people in the communities.”
Deles, for her part, said “we remain hopeful and confident that Congress will pass a meaningful BBL for lasting peace and development in Southern Philippines in accordance with the mandate of the constitution.”
Just yesterday, Deles, Ferrer, MILF chief negotiator Mohagher Iqbal and members of both peace panels and the Bangsamoro Transition Commission, which drafted the BBL, met with House Ad Hoc Committee Chair Rufus Rodriguez and his vice-chairs to discuss concerns on the draft law. |

Budget Secretary Florencio “Butch” Abad today slammed allegations made by Bonifacio Alentajan—who recently filed a motion in the Sandiganbayan to implead Abad in a string of Priority Development Assistance Fund (PDAF) cases—saying that these claims were “divorced from reality” and “lacked substance.”
“The motion filed by Attorney Bonifacio Alentajan is total nonsense. Not only are his accusations devoid of substance—they are also completely divorced from reality. For one, the alleged irregularities covered in the complaint took place between 2007 and 2009. I wasn’t even Budget Secretary then. Neither was I holding public office in that period,” Abad said.
Public records show that Abad served as the representative of the lone district of Batanes from 1987 to 1989, and again from 1995 to 2004. He was appointed Secretary of the Department of Education (DepEd) in 2004, but he resigned the next year as part of the Hyatt 10, following the Hello Garci exposé and growing concerns on the legitimacy of the Arroyo administration. He began his term as Department of Budget and Management (DBM) Secretary under the new Aquino Administration in 2010.
The Budget chief also struck at Alentajan’s claim that Special Allotment Release Orders (SAROs) and the Notices of Cash Allocations (NCAs) were only issued under Abad’s specific authority.
“Alentajan needs to get his facts straight. Since I assumed my post in 2010, the authority to sign these SAROs and NCAs has actually been delegated to an Undersecretary,” Abad said.
“It is impossible to take Alentajan’s case seriously. I seriously doubt that he will pursue this case with any sort of moral conviction, given the weakness of his arguments. It seems fairly clear that Alentajan is only acting under orders here, specifically to discredit my name. Giving him any measure of attention would only be a waste of time,” he added.
The Budget chief also emphasized the need to support the Office of the Ombudsman and the Sandiganbayan in their pursuit of various corruption cases, including those related to PDAF misuse.
“We in the DBM join the public in their call for accountability, especially in the misuse of public funds. At the same time, we continue to support the Office of the Ombudsman and the Sandiganbayan in their pursuit of corruption cases, including those related to the PDAF scam. However, baseless allegations like Alentajan’s do not help the cause of justice. They only undermine it,” Abad said. |

11 August 2015 – The “Queen City of the South” will host the APEC Third Senior Officials’ Meeting (SOM) and Related Meetings from August 22 to September 06. Delegates from 21 APEC-member economies will experience the warm hospitality and vibrant atmosphere of Cebu’s bustling metropolis.
SOM 3, traditionally the most heavily attended due to the number of meetings, brings together APEC Working Groups, Sub-fora and Committees to continue discussions on trade and investment liberalization, business facilitation, and economic cooperation within the Asia-Pacific region. Issues to be tackled, range from illegal logging; mining; health; counter-terrorism; food safety; intellectual property rights; standards and conformance; sustainability of cities; disaster risk management, among others. These meetings continue to strengthen this year’s four priorities under the overarching theme of “Building Economies, Building a Better World”: 1) enhancing regional economic integration; 2) fostering MSMEs’ participation in regional and global markets; 3) investing in human capital development and 4) building sustainable and resilient communities.
The culminating event is the Senior Officials’ Meeting on September 05 to 06 where Vice Ministers and Directors General will endorse initiatives that aim to make the region more dynamic, resilient, and inclusive.
The Cebu meeting follows the successful Senior Officials’ Meeting (SOM) and Related Meetings and the Ministers Responsible for Trade (MRT) in Boracay in May.
Following the SOM are two Ministerial-level meetings: the Structural Reform Ministerial Meeting (SRMM) on September 07 to 08 and the Finance Ministerial Meeting (FMM) on September 09 to 11 September 2015. Efforts to improve farmers’ agricultural production got a big boost as the Department of Agrarian Reform (DAR) turned over 21 farm machineries worth P3.7 million to farmers’ cooperatives in Ilocos Norte.
The farm machines consisting of 13 hand tractors, six rice threshers and two rice reapers were turned over to 20 cooperatives where around 3,000 are agrarian reform beneficiary members.
“These mechanized farm implements will greatly increase farmers’ yield. And if their yield is bigger, their household income will be bigger too,” said Provincial Agrarian Reform Program Officer Vic Ines.
Ines explained that the farm implements were given as “equipment grant” which will be operated by farm cooperatives as a business asset where user fees will be collected and will be utilized for the operation and maintenance of the farm equipment.
The project is being implemented under DAR’s Agrarian Reform Community Connectivity and Economic Support Services (ARCCESS), which aims to transform ARBs into viable entrepreneurs by providing them support services to increase their income and farming capabilities.

The financial bids of real estate titans Ayala Land Inc. and Filinvest Development Corporation for the South Integrated Transport System project of the Department of Transportation and Communications (DOTC) were opened yesterday, signaling the winding down of the bidding process for the PhP 4 billion passenger terminal to be located at the former FTI complex in Taguig.
DOTC Undersecretary Jose Perpetuo M. Lotilla, Chair of the DOTC Bids and Awards Committee, announced the bids of the two real estate conglomerates, with Ayala Land Inc. posting the lowest Annual Grantor Payments bid at PhP 227,888,888.88. Filinvest Development Corporation on the other hand placed a PhP 1 billion bid.
Annual Grantor Payments (AGP) are payments to be made by the government to the concessionaire for financing, constructing, operating and maintaining the South ITS Project during the 35-year concession period. Thus, the lowest AGP is the one most favorable to government.
As the operator of the transport terminal, the private partner can construct commercial establishments and operate commercial facilities at the terminal.
The South Terminal will connect passengers and commuters from the Laguna-Batangas areas to the other transport systems in Metro Manila, including several commuter train systems. These include city buses, taxis, and other public utility vehicles that ply along EDSA.
The Project will be implemented using a Build-Transfer-and-Operate (“BTO”) arrangement where the private partner builds the facility on a turnkey basis, as well as assuming cost overruns, delays and specified performance risks for the project. The terminal will include a modern passenger terminal building, arrival and departure bays, ticketing and baggage holding facilities and parking.
As soon as the construction of the terminal is finished, it will then be turned over to the DOTC. Based on the concession agreement to be signed, the operations and maintenance of the transport terminal will be the responsibility of the private partner, following agreed specific performance standards and specifications.
Under RA 7718 or the BOT Law, the Implementing Agency is given 15 days to evaluate the financial proposals. According to the DOTC-BAC, evaluation for the financial submissions may be shorter.
The DOTC targets to release the results of the financial evaluation by next week.
The Notice of Award will be issued by the Project Bids and Awards Committee by the end of this month. |

Ang tanong sa mga panahong iyon, paano natin ito lalabanan? Di naman kaila: Ang mga barkong humaharang, galing sa isang bansang di-hamak na mas malakas ang kakayahang pangmilitar kaysa sa atin. Kung ikukumpara nga, hindi bababa sa dalawang modernong sasakyang-pandagat ang meron sila sa mga panahong iyon; tayo naman, may dalawa rin, pero mga fishing vessels, na once upon a time po ay bago rin. Kumbaga sa boksing, parang pinagtapat ang isang heavyweight sa isang bantamweight. Di po ba’t malinaw na hindi patas ang laban?
Pero alam naman ninyo ang nangyari: Mission accomplished ang Philippine Navy—tagumpay ang paghahatid natin ng supply sa Sierra Madre. Dehado man tayo sa sasakyan at kagamitan, ang atin namang mga kawal ay hindi nagkulang sa tapang, diskarte, at paninindigang tuparin ang tungkulin at ipagtanggol ang ating karapatan.
Nitong mga nakaraang taon, patong-patong din ang mga pagsubok na pinagdaanan ng ating bansa—mula sa krisis sa Zamboanga, lindol sa Cebu at Bohol, at paghagupit ni Yolanda, hanggang sa mga panibagong hamon sa kasalukuyan. Sa lahat ng ito, kayo ang nagtitimon sa ating mga sasakyang-pandagat upang protektahan at bigyan ng ayuda ang mga nangangailangan. Talagang nababawasan, kundi man natatanggal, ang aking pangamba, dahil sa bawat sandali, alam kong nariyan kayo upang maglingkod sa bayan. Laging ipinapaalala ng hanay ninyo: Totoong hindi ako nag-iisa.
Damang-dama ko rin po: Pinagpala akong makatagpo at makapagtalaga ng mga tapat, mahuhusay at maaasahang pinuno sa ating pamahalaan. Imbes na maging pabigat, naging kabalikat natin sila sa pagpasan at pagresolba sa mga pagsubok na ating sinuong at hinarap.
Ito nga po ang huli kong pagpapalit-atas sa Philippine Navy bilang inyong Commander-in-Chief. Ang totoo po, kada change-of-command ceremony na pinangungunahan natin, magkahalong emosyon ang aking nadarama. Panghihinayang, dahil heto’t dumarating ang panahong may mahusay na pinunong kailangang magpaalam sa serbisyo. Sa kabilang banda naman, nagagalak ako sa pagpapakitang-gilas ng ating mga iniluluklok. Sa pagbaba nila sa puwesto, hindi sila nakatungo, bagkus, taas-noo nilang masasabing ginawa nila nang mahusay at marangal ang trabaho.
Patunay dito si Vice Admiral Jess Millan. Bilang Flag Officer in Command, iniangkla niya sa Navy Strategic Sail Plan 2020 ang bawat programa’t inisyatiba ng inyong hukbo, tungo sa mas matatag at mas maunlad na institusyon. Nanindigan siya sa isang pilosopiya: Ang maglingkod nang tama, makatwiran, at may dangal. Pinaigting niya ang inyong mga combat training, at isinulong ang mas epektibong paghahatid ng serbisyo. Dagdag pa rito, aktibo rin niyang itinaguyod ang mas matibay na ugnayan sa mga katuwang natin sa loob at labas ng bansa, na nagbunsod naman ng higit na estabilidad at kapayapaan sa ating rehiyon.
Sagisag nga po ang araw na ito sa pagsasara ng isang kabanata sa Hukbong Dagat sa ilalim ng huwarang pinuno. Gayumpaman, ang mga repormang ipinatupad ni Vice Admiral Millan sa institusyong ito, pati na ang kanyang natatanging disiplina at dedikasyon, ay habambuhay nang nakatatak sa mga kapwa pinuno at kasama sa serbisyo. [Tawanan at palakpakan] Sabi po nila, dahil sa celebrity look mo, marami raw ang nagpapa-selfie sa ’yo; itinuturing ka ring henyo dahil sa talas ng isip mo, partikular na sa mathematics. Pero nang makapanayam kita, isang pambihirang katangian ang nakita kong higit na nangibabaw sa iyo: ang pagiging simple at mapagkumbaba.
Rear Admiral Taccad: Di biro ang bago mong tungkulin; masalimuot ang mga pagsubok na hinaharap ng ating bansa. Kailangan mong balansehin ang kapasidad ng ating hukbo sa pagtugon sa mga banta sa ating seguridad. Tiwala naman akong tulad ng ipinamalas mo hanggang sa puntong ito ng iyong karera, higit ka pang magpapakitang-gilas, at titiyakin mong susulong ang Navy Strategic Sail Plan 2020 ng ating Hukbong Dagat.
Sa mga napasama naman sa listahan ng pagpipilian bilang bagong hepe ng Navy, subalit hindi natin napili: Alam kong taas-noo at patuloy pa rin kayong magsisilbi sa ating hukbo. At maraming salamat din po sa inyong lahat.
Habang pinapaunlad naman natin ang kabuuang estado ng ating bansa, tuloy ang pagpapaarangkada natin sa ating buong Sandatahang Lakas. Sa paglago ng ating ekonomiya at pag-unlad ng kakayahan ng taumbayan, higit nating natutugunan ang inyong mga pangangailangan. Ang pinakahuli ngang balita: Nitong Biyernes lang, dumaong na sa Sangley Point sa Cavite ang dalawang Landing Craft Heavy mula sa Australia, at ngayon naman ay narito na sa Navy Headquarters. Tatlo pa ang target nating makuha; inaasikaso na natin ang papeles nito para sumulong ang proseso. At ang mga bagong barkong ito, magiging katuwang ng ating mga landing craft utilities, kasama ang BRP Tagbanua. Sila ang titiyak na kapag panahon ng sakuna, mas mabilis na ang paghahatid natin ng ayuda, kabilang na ang naglalakihang equipment, sa iba’t ibang panig ng bansa.
Ito pong ating mga inisyatiba, nakatutok pa rin sa pagbibigay-lakas at kakayahan sa ating unipormadong hanay. Bilang inyong Commander-in-Chief, batid kong araw-gabi, tirik man ang araw o humahampas ang malalakas na hangin at bagyo, nariyan kayo, bantay-sarado sa ating mga teritoryo, at nakatindig para pangalagaan ang kapakanan ng mamamayan. Hindi man nakukuhanan ng litrato o video; natatabunan man ng ibang balita sa diyaryo; mulat akong hindi kayo napapanghinaan ng loob, buong-buo ang inyong dedikasyon sa pagtupad sa sinumpaan ninyong tungkulin. Saludo ako sa ipinapakita ninyong wagas na serbisyo para sa bandila at sa sambayanang Pilipino.
Naniniwala po tayo: Kayong mga kumakalinga sa bayan at sa mga Pilipino, kailangan ding arugain ng estado. Positibong siklo naman ito: Sa pag-unlad ninyo at paghusay ng inyong serbisyo, mas mapapalapit sa inyo ang tao; lalo na, dahil nakikita nilang sulit ang ipinupuhunan sa inyo ng lipunan. Ang resulta naman nito, nakikibalikat sa inyo ang mamamayan, gagaan ang inyong trabaho, kabilang na ang trabaho namin sa sangay ng Ehekutibo, at sa kabuuan, mapapadali ang pag-unlad ng buong bansa.
Mga kasamahan sa paglilingkod-bayan, totoong simula pa lang ang lahat ng ito. Ngayon, higit kailanman, tinatawag tayong makisagwan upang maisulong ang maganda nating nasimulan. Totoong nasa iisang bangka lang ang sambayanang Pilipino. SEC. COLOMA: Magandang umaga sa iyo, Alan, at sa ating mga tagasubaybay.
ALAN: Yes, sir. Secretary Coloma, isa po sa mga napapag-usapan ay ito pong pag-a-allot ng bahagi ng 2016 proposed national budget para daw po sa dagdag ng sahod ng ating mga nagtatrabaho sa pamahalaan na mga state workers. Bigyan n’yo nga po kami, sir, ng update tungkol dito, Secretary Coloma, sir, please?
SEC. COLOMA: Patuloy pong tinitingnan ng pamahalaan kung paano mapapabuti ang kabuhayan ng mga lingkod bayan. At sa unang bahagi ng kasalukuyang administrasyon ay ipinatupad iyong first, second and third tranche ng Salary Standardization Law, at pagkatapos noon ay patuloy pa ring pinag-aralan kung paano mapapabuti ang salary scales dahil nga ayon sa pahayag ni Secretary Abad ng DBM, masyadong malaki iyong … nais nating maging comparable o maihambing iyong suweldo sa gobyerno sa mga suweldong tinatanggap ng mga nagtatrabaho sa private sector. Kaya iyan ang nagbunsod ng programa o plano na dagdagan iyong … o maglaan ng pondo para sa pagpapataas ng salary scale ng ating mga empleyado.
ALAN: Opo. Meron po bang napapag-usapan na kung ito ho will take another form of salary standardization para sa mga government workers which will probably come in several tranches, Sec. Sonny, sir?
SEC. COLOMA: Wala pa tayong nakikitang detalyadong plano hinggil diyan. Meron tayong mga narinig na panukala sa Lehislatura. Pero kagaya ng nalalalaman natin, Alan, kapag nagpasa ng batas, bahagi doon sa pagpapasa ng batas ay pagtitiyak na mayroong pondo. Kaya mainam na doon sa budget proposal for 2016 ay meron nang nakalaan na pondo. Ibig sabihin, kapag mayroong nabuong batas hinggil diyan ay puwede nang … masasabi natin na mayroong nakalaang pondo at dadagdag iyong probabilidad na maipapatupad sa ganito. Pero doon sa natunghayan natin, ang pahayag lang naman ni Secretary Abad ay kailangan ito ng approval ni Pangulong Aquino.

Kaya sa tingin ko ay isa rin iyan sa mga dahilan kung bakit nakapaglaan na ng halaga para sa pagpapataas ng suweldo ng mga kawani sa gobyerno dahil nga natukoy na rin iyong tungkol sa isyu ng pagbabayad ng karagdagang pension. Iyan po ang isa sa mga factors kung bakit hindi maituloy iyong dating balak na pagpapataas ng suweldo dahil doon lamang sa isang sektor ng napakalaking bahagdan ‘no, ng buong government employees sector, iyon pong binubuo ng mga sundalo at pulis, ay meron ng malaking isyu. Ngayon at na-address na po iyong isyu na iyon ay nagkakaroon na po ng linaw iyong daan patungo sa pagpapataas ng suweldo sa public sector.
ALAN: Naku, magandang balita po iyan, Secretary Coloma. Sa ibang usapin naman po, Secretary. But, of course, we understand na sa panig po ng gobyerno, may partnership pa nga with the private sector para mapabilis iyong pagkakaloob ng mga resettlement o iyong mga bagong matitirhan doon sa mga na-displace ng Bagyong Yolanda, Secretary. Any updates sa aspetong ito po?
SEC. COLOMA: Patuloy pong tinutukoy ng National Housing Authority iyong pagpapatayo ng bagong permanente at matibay na pabahay. Malaki lang po talaga iyong scope na kanilang binubuno dahil 205,000 housing units po ang tinutukoy natin diyan. At malaking bahagi po nito, nagre-require ng resettlement dahil nga iyong pinanggalingan ng mga pamilyang na nasalanta ng Supertyphoon Yolanda ay nakatira doon sa mga danger zones na idineklara nang “no build zones”.
Kaya iyon po ang isa sa mga tinutukoy ng pamahalaan, iyong pagpili ng mga resettlement area na magiging kapaki-pakinabang dahil kinakailangan po kumpleto iyong pasilidad doon. Magkakaroon po ng utilities, tubig, kuryente at mga livelihood clusters din po ay itatatag doon para may kabuhayan sila dahil hindi naman po lahat ay doon din sa lugar na pinanggalingan. Kaya nga po ‘resettlement’ ay panibagong lugar. At iyong mga malalaking lugar na available, usually po iyan ay hindi pa masyadong developed areas. Kaya iyan po ang binubuno ng pamahalaan sa kasalukuyan.
ALAN: Opo. Tungkol pa rin po sa mga proyekto sa ibang areas outside of Metro Manila. Meron pong nilabas na kautusan ang Pangulong Noy para sa lahat ng mga government agencies na tumulong dito po sa tinatawag na transition sa Negros Island Region. Papaano po ito, parang palalakasin ang Negros Island bilang isang investment area o any updates sa aspetong ito, Sec. Sonny, sir?
SEC. COLOMA: Ang pinanggalingan kasi niyan, Alan, ay hiwalay iyong rehiyon ng dalawang bahagi ng Negros Island. Iyong Negros Oriental ay dating kabilang sa Region VII na kasama iyong Cebu, Bohol at Siquijor; iyon namang Negros Occidental ay nasa Region VI na kasama iyong mga lalawigan sa Panay Island, iyong Iloilo, Antique, Capiz, Guimaras – iyon ang kaniyang region. Siyempre madali nang makita iyong logic diyan, iisang landmass lang sila at pareho silang Negrense ‘no, mas mainam talaga na pag-isahin na iyong development nila. Dahil para bang ang pinanggagalingan pa ng kanilang connectivity noon ay tatawid pa ng karagatan iyong bawat isa dito sa mga lalawigang nito.
Kaya iyon ang pinanggalingan nitong Negros Island Region. Ang tutunguhan naman ay iyong mas masinsin na … siguro matawag nating integration ng kanilang mga development program, at ito ang dahilan kung bakit nagtatag ng isang inter-agency body na tutukuyin nito, Alan. Isa sa mga gagawin nila ay iyong pag-identify ng bagong regional center dahil iisang rehiyon na nga sila at iyong paglulugaran ng mga regional offices ng iba’t ibang ahensiya ng pamahalaan. Inaasahan natin na mapagbubuti naman nila itong pagtukoy dito para mas mabilis na pag-unlad ng Negros Island.

Leo Navarro (Brigada News): Good afternoon, secretary. Ang question po: Sa susunod na linggo kasi sisimulan na ‘yung pagtalakay ng Senado sa BBL (Bangsamoro Basic Law) pero ilang senador po ‘yung hindi kumbinsido na magdudulot daw ito ng kapayapaan at progreso sa Mindanao, secretary?
SEC. COLOMA: Ang joint committee report ay nilagdaan ng labing-pitong senador at karamihan sa kanila ang nagpahiwatig ng paninindigan na dapat nang umpisahan ang pagtatalakay ng BBL sa plenaryo. Patuloy kaming nakikipag-ugnayan sa liderato ng Kongreso sa pagpasa ng isang BBL na magtataguyod ng pangmatagalang kapayapaan at pag-unlad.
Ms. Navarro: Follow up po, sec. As per Senator Bongbong Marcos, hindi raw po—‘yung version yata niya ng BBL ay hindi na exclusive sa MILF (Moro Islamic Liberation Front) ‘yung saklaw nito at ‘yung mga—kumbaga ‘yung mga stakeholders dito?
SEC. COLOMA: Ang tinutukoy po natin dito ay committee report. ‘Yung committee report ay maraming tinatakalay na mga isyu hinggil doon sa naihain na Senate bill hinggil dito sa BBL. At mainam siguro na yaman din lamang at pumirma na ang mga senador, senyales na ito na handa na silang umpisahan ang pagtalakay nito sa plenaryo. Ang ating tinutukoy dito ay ‘yung pagsulong sa prosesong pangkapayapaan at umaasa tayo na magkakaroon ng kaliwanagan ang mga isyu na ilalahad nila, bahagi ng kanilang pagtatalakay sa draft BBL.

Andreo Calonzo (GMA News Online): Sir, but does the Palace maintain its stand that the BBL should be passed as close as possible to the original draft as crafted by the peace panel po?
SEC. COLOMA: Ang posisyon natin dito ay malinaw. Kailangang magkaroon ng Bangsamoro Basic Law na magtataguyod at magsusulong sa prosesong pangkapayapaan at may mga mahahalagang probisyon ito na naaayon sa mga kasunduang nilagdaan ng Philippine at MILF panels.
Iyong pagbubuo ng isang batas ay nasa kamay ng mga halal na kinatawan at senador. At sa ating demokrasya ay nararapat lamang na talakayin ang mga mahahalagang isyu na nakapaloob sa anumang panukalang batas, at umaasa tayo na ang resulta ng kanilang pagtatalakayan ay ang pagsusulong ng prosesong pangkapayapaan.
Mr. Calonzo: Sir, ‘yung mga mahahalagang probisyon po ba na nabanggit niyo ay nandoon pa rin sa draft ni Senator Marcos?
SEC. COLOMA: Wala pa akong pagkakataon na mabasa o tunghayan ‘yung buong report. Ang pinagbabatayan natin ay ‘yung mga nailathalang pahayag ng mga senador.

SEC. COLOMA: The nation lost an outstanding Olympian and a respected business leader with the passing of Arturo D. Macapagal this morning.
Mr. Macapagal represented the country in the 1972 (Munich) and 1976 (Montreal) Olympic Games and held the national record in Olympic free pistol shooting for more than 21 years.
He is a recognized leader in the automotive industry and is a staunch supporter of various socio-civic organizations such as Habitat for Humanity and Scholarship Foundation for the Filipino Youth, where he served as Chairman.
We extend our condolences to the bereaved family of Mr. Macapagal.

Patuloy ang pagpapatupad ng pamahalaan ng mga programa upang pahusayin ang paglaban sa kriminalidad at paglutas sa mga tinaguriang extra-judicial killings, pagpapalawak ng sakop ng PhilHealth, at pagdagdag sa supply ng kuryente. Sa kasalukuyan, puspusan ang pagpapatupad ng mga programang mag-aangat sa kabuhayan ng mga mamamayang Pilipino.
Ms. Alviz: Sir, may update na po ba doon sa coalition with NPC (Nationalist People's Coalition) after the party said na kung tatakbo po si Senator Grace Poe ay siya ang susuportahan nila, and today may naka-set po yatang meeting si Secretary Mar (Roxas) with NPC?
SEC. COLOMA: Wala po akong tuwirang impormasyon hinggil sa bagay na ‘yan hanggang sa kasalukuyan.
Ms. Alviz: Pero sir ‘yung administration ba is hoping to maintain the coalition with NPC?
SEC. COLOMA: Batay sa mga pahayag ni Pangulong Aquino, ang inaasam na matamong sitwasyon ay ‘yung pananatili at pagpapatuloy ng administration coalition, lalong-lalo na doon sa aspeto ng pagpapatatag sa mga repormang naipatupad na at pagiging permanente ng transpormasyon ng ating bansa. Makailang ulit na sinabi ng Pangulo na mainam kung maipagpapatuloy ang coalition sa pagtataguyod ng matuwid na daan.

Ang tangi lang po nating masasabi ay 'yung paninindigan ni Pangulong Aquino na dapat ang ating itinataguyod ay 'yung pagpapatuloy ng mga reporma, 'yung pagpapatuloy ng mga prinsipyo ng matuwid na daan at hindi po tayo lumalahok sa mga usaping taliwas sa prinsipyong iyan.

Ang tanong po ng ating mga kababayan ipapasa po ito sa mga consumer at ayon sa Water for All (Refund) Movement malinaw na ang mga boss ng Pangulo ay ang mga nagmamay-ari ng dalawang concessionaires ng Manila Water o itong Maynilad na sila Pangilinan at Ayala dahil pinayagan ng Pangulo 'yung pagpapataw na ito ng corporate income taxes na sisingilin sa ating mga consumer. Ano po ang reaksyon ng Palasyo?
SEC. COLOMA: Isinasaalang-alang ng pamahalaan ang kapakanan ng mga mamamayan hinggil sa tamang presyo ng tubig. Patuloy na tinatalakay kung paano tutukuyin ang isyu hinggil sa pagtatakda ng singil sa tubig.
Mr. Rosales: Na-inquire niyo na po ba 'yan kay Secretary Purisima kung totoo po na pinayagan ng Malakanyang 'yung ganoong pagpapataw?
SEC. COLOMA: Ayon po sa mga nailathalang ulat hinggil sa idinaos na hearing sa Kamara kahapon patungkol sa presentasyon ng pamahalaan sa 2016 National Budget, ito 'yung Development Budget Coordinating Committee, kabilang diyan sina DBM Secretary Florencio Abad, Finance Secretary Cesar Purisima. Sila po ay itinanong hinggil sa mga isyu na 'yan at ipinaliwanag ni Secretary Purisima 'yung batayan sa inilahad niyang posisyon doon sa kanyang memorandum.
Sa kabilang dako naman ay mayroon ding posisyon ang MWSS hinggil sa tamang interpretasyon 'nung prinsipyo ng—'nung mga prinsipyo o probisyon hinggil sa kontrata ng mga water concessionaires at kung paano o magkano ang puwedeng ipasa sa mga actual na consumers. Iyan ang aking ibig sabihin doon sa pagsasabing patuloy na tinatalakay pa 'yung isyung ito dahil hindi magkatugmang eksakto 'yung kanilang mga posisyon. Mayroong mga interpretasyon na maaari pa namang ipagpaliban 'yung pagpapatupad dahil ayon naman doon sa umiiral na kasunduan, puwede naman itong—puwedeng gumawa ng karagdagang pagsingil doon sa loob ng kabuuan ng concession period.
Kaya iyan ang ibig nating sabihin doon sa patuloy na pagtatalakay diyan sa isyu. At sa harap ng mga iyan, ang sinusunod nating prinsipyo ay dapat na maging makatuwiran ang pagsingil. Dapat ay isaalang-alang ang kapakanan ng mga mamamayan hinggil sa tamang presyo ng tubig.
Mr. Rosales: Sir, last question. So hindi po totoo 'yung alegasyon ng Water for All (Refund) Movement na 'yung mga malalaking negosyante at mga donors ng Pangulo noong 2010 elections ang kanyang mga boss, kundi ang mga boss ay 'yung taumbayan?
SEC. COLOMA: Hindi ko na po uulitin dahil sa kanila namang posisyon iyan at hindi sa amin.
Reymund Tinaza (Bombo Radyo): Sir, magandang hapon po. Sir, paano po natin ipapaliwanag ito dahil mismong si Secretary Villanueva 'yung naglabas ng kanyang sentimyento against the group of Secretary Mar Roxas?
SEC. COLOMA: Batay po sa aking pakikipag-usap sa kanya ito 'yung kanyang saloobin. Una, siya ay nabigla dahil siya ay naisama doon sa impormasyon na prinisenta ng NBI (National Bureau of Investigation) sa Office of the Ombudsman, at ang kanyang pagkabigla ay dahil sa kanyang paninindigan na wala siyang kinalaman sa mga alegasyon na nakapaloob doon sa impormasyon.
Pangalawang pahayag ni Secretary Villanueva, sa kabila ng ginagawang paninira sa kanyang karangalan dahil nga sa kanyang deklarasyon na wala siyang kinalaman diyan ay matibay ang kanyang commitment sa pagpapatupad ng mga patakaran ni Pangulong Aquino. At iyon ang kanyang pahayag.
Mr. Tinaza: So can we say na walang umiiral na hidwaan at inggitan sa inyong hanay sa Gabinete?
SEC. COLOMA: Uulitin ko ang aking sinabi, una, sinabi niya na siya ay nabigla at ang kanyang pagkabigla ay dahil sa kanyang paninindigan na wala siyang kinalaman sa mga inihaing impormasyon; at, ikalawa, patuloy ang kanyang pagtataguyod sa programa de gobyerno ni Pangulong Aquino.
Mr. Tinaza: Sir, isa pang punto. Iyon pong motion to implead na inihain ni Atty. (Bonifacio) Alentajan para daw dapat isama itong si DBM Secretary Butch Abad sa kasong plunder, he, being the government official who has the authority to sign or to—parang naglabas ng SAROs and mga paglalabas ng pondo regarding the pork barrel scam. So medyo... Ang meron lang nakakabitin kasi—medyo pabalang 'yung sagot at hindi tinukoy 'yung kanyang—at hinamon lamang si Atty. Alentajan na bumalik sa law school. Baka meron po kayong mas matino, mas malinaw na pagpapaliwanag, you being the parang kumakatawan sa Gabinete sa ganitong pagkakadiin ng kapwa niyo miyembro ng official family, secretary?
SEC. COLOMA: Sa atin pong pagkabatid, 'yung mga tinutukoy na paratang hinggil sa maling paggamit ng pondo ng bayan, ayon na rin mismo sa special audit report ng COA, ay naganap noong 2007, 2008, ang karamihan sa mga transaksyon na ito. At hindi naman po ang kasalukuyang administrasyon ang nanunungkulan noon.
So paano kaya magkakaroon ng katuwiran 'yung alegasyon hinggil sa partisipasyon diyan ni Secretary Abad dahil hindi naman po siya naninilbihan sa Department of Budget and Management doon sa panahong iyon. Napakasimple lang po ng datos na dapat maunawaan diyan. Kung ang tinutukoy ay mga transaksyon 'nung nakaraang administrasyon, paano naman po magkakaroon ng katuwiran na ang papanagutin 'yung nanunungkulan sa kasalukuyan.
Mr. Tinaza: Sir, last point. Over the weekend, I understand kayo mismo ay nagpaliwanag at nagdepensa doon sa alleged parang masyadong malaking allowance kay RTVM Director Lito Nadal at well, base ito sa COA report. So paano niyo tinatrato dahil usually ay naglalabas 'yung COA considering this is a raw report at it has yet to be verified and to be answered, explained by the involved official. So paano niyo po tinatrato? Meron ba kayong parang—kasi minsan doon nagkakaroon ng intriga e, 'yung nilalabas nila kaagad tapos hindi pa naman ito naipaliwanag ng concerned official. So how do you treat that? Kasi parang I understand kayo mismo ay nagtaka doon sa report against kay Director Nadal?
SEC. COLOMA: Pahayagan po at hindi COA ang naglabas ng istorya. Ang nilalabas lang po ng COA ay report.
Mr. Tinaza: Pero doon po ibinase ang kanilang report dahil sa inilabas na figure.
SEC. COLOMA: Ang inaasahan ng mga mamamayan ay sa paglalahad ng impormasyon sa publiko ay magiging makatotohanan ito at magiging tama ang mga paksa na tinutukoy. Kaya't sa natunghayan ninyong istorya, lumiham ako sa pahayagang tinutukoy at sinabi ko na ang ulat doon sa kanilang unang nilathalang istorya ay "inaccurate," "misleading" at "derogatory."
Una, ang lahat ng mga tinutukoy doon ay mga pasweldo o iyon pong itinakdang sweldo ng mga opisyal ng naaayon sa batas. Pangalawa, 'yung allowance na tinanggap o mga tinatanggap ay ayon naman sa mga iba't ibang tungkuling ginagampanan. Batid natin na ang ginagampanang tungkulin ni Assistant Secretary Virgilio Nadal Jr. ay bilang pinuno ng Presidential Broadcast Staff o Radio TV Malacañang at ang pangkat na ito ay mayroong tungkuling mag-provide ng audio visual coverage sa lahat ng mga presidential events, including foreign trips.
Kaya 'yung malaking halaga na kanilang tinutukoy ay naaayon naman sa mga officially determined rates of allowances. Halimbawa, ay 'yung sa hotel at accommodations, ang pinagbabatayan ng DBM dito ay 'yung rates ng mga international organizations.
Ms. Marie Peña-Ruiz: UNDP.
SEC. COLOMA: Oo, UNDP (United Nations Development Programme) rates. Pangatlo, hindi rin tama 'yung nilagay doon na siya ay chief videographer. Siya ay Assistant Secretary at namumuno siya sa pangkat ng mga empleyado na kabilang doon ay mga videographer at camera persons.
So iyon po. At pinakahuli, na sa tingin natin ay derogatory, mayroon pong pangungusap doon "that Assistant Secretary Nadal pocketed P2.7 million in salaries and allowances." Sa pangkaraniwan po nating pagkaunawa sa wikang Pilipino, ang direct translation ng pocketed ay "ibinulsa."
So wala naman pong katuwiran iyon at hindi naman po fair 'yung ganoong paglalahad. So iyon lang naman po ang ating sinabi. Ang batid po natin ay nilalabas ng COA 'yung talaan ng mga opisyal at kung ano 'yung mga tinanggap nilang sweldo sa taong lumipas. At wala naman silang istoryang sinusulat, nililista lang naman nila kung ano 'yung mga tinanggap.
Mr. Tinaza: Sir, but with due respect sa COA, kasi DFA (Department of Foreign Affairs) statement categorically mentioned na 'yung COA report is misleading because like, for example, 'yung ambassador allowances, sinum-up (sum up) nila as personal account or personal allowance iyong amount paid to the owner of the property or house being rented in the host country. So DFA mismo ang nagsabi na parang misleading 'yung COA report dahil tinotal 'yung allowance and 'yung hiwalay na salary nila. So parang wala ba kayong appeal sa COA na... I mean to at least to act with care and prudence sa paglalabas ng mga figures that could be lifted from their report so mai-interpret in one way or the other?
SEC. COLOMA: Kinikilala po natin 'yung tungkulin ng Commission on Audit bilang independent constitutional body. Nais ko pong malaman 'yung kongkretong batayan 'nung pahayag ng DFA dahil siguro po para maging fair, kailangan kong matunghayan mismo 'yung report na tinutukoy at hindi naman natin nakita kung paano 'yung appearance or actual reporting form na ginagamit ng Commission on Audit. Hindi naman po responsable kung magpaparatang tayo na hindi natin nakita 'yung report mismo.
Sapat na siguro sa ngayon 'yung paglilinaw ng Department of Foreign Affairs na malaking bahagi 'nung allowances na tinutukoy na natanggap ng mga ambassadors natin, hindi naman 'yon nagpunta sa kanilang sariling kapakanan, kung hindi sa pagbabayad ng mga pasilidad na ginagamit ng ambassador at sa maraming lugar po na nabanggit, iyong halaga ng lodging or cost of living ay mas mataas doon sa pangkaraniwang batid natin na mga halaga batay sa mga halaga dito sa ating bansa.
Kaya dapat sigurong suriin nang mabuti 'yung actual na report at kung paano ito pinipresenta. Ang pagkaunawa ko lang po ay nilinaw lang ng DFA na iyong mga allowances na tinutukoy ay hindi naman para sa personal account 'nung ambassador pero para bayaran 'yung mga cost of living expenses being posted in a foreign country.
