APEC organizers host disco party for Senior Officials’ Meeting delegates
 
(BORACAY ISLAND, Aklan) The Asia-Pacific Economic Cooperation 2015 National Organizing Council (APEC NOC), together with other government agencies, hosted a welcome dinner for delegates to the Second Senior Officials' Meeting (SOM2) at the beachfront of the Pearl of the Pacific Boracay Resort here Wednesday.

In her welcome remarks, SOM Chair, Foreign Affairs Undersecretary Laura del Rosario, enjoined the delegates to have fun during the 1980s disco-themed party, dubbed "FuntaSea!",

There to entertain the guests were Bituin Escalante, Ballet Philippines, Daloy Dance Company, Myke Salomon, Those Damn Nerds, Diwa De Leon Group, Coral Queenies, Boracay Fire Dancers, and the Black Beauty Boys.

The APEC NOC got help from the Department of Tourism and the Cultural Center of the Philippines in organizing Wednesday's social event.

APEC meetings are being held here in Boracay, an island with an area of more than 1,000 hectares, to promote regional trade and tourism.

The island has an annual tourist arrival of 1.5 million and the Department of Tourism wants to increase the figure to 2.8 million by 2018.

The local government of Malay, Aklan said it is carrying out a Boracay redevelopment plan that entails the relocation of non-tourism activities to the mainland, in an effort to further boost tourism-related activities in the island. PND (as)

World Trade Organization Chief calls on President Aquino
 
Director General of the World Trade Organization (WTO), Brazilian Roberto Azevêdo, paid a courtesy call on President Benigno S. Aquino III in Malacañang on Thursday.

Azevêdo was accompanied by his chief of staff, Tim Yeend of Australia, and counselor, Aegyoung Jung of Korea.

Joining President Aquino in welcoming the WTO officials were Trade and Industry Secretary Gregory Domingo, Acting Foreign Affairs Secretary Evan Garcia, Finance Undersecretary Carlo Carag, National Economic and Development Authority Deputy Director General Rolando Tungpalan, and Philippine Permanent Representative to the WTO, Ambassador Esteban Conejos, Jr.

Azevêdo, who arrived in the Philippines last Tuesday, is scheduled to attend the Asia-Pacific Economic Cooperation (APEC) Ministers Responsible for Trade Meeting on May 23 to 24 on Boracay Island in Aklan province.

The Brazilian diplomat was elected as the sixth director general of the WTO in 2013, succeeding Pascal Lamy. PND (jm)

President Aquino receives credentials of four new ambassadors
 
President Benigno S. Aquino III on Thursday received the credentials of four new Resident Ambassadors-Designate to the Philippines at the Music Room of Malacañang Palace.

First to present his credentials was David John Strachan of New Zealand. He was joined by his country’s Defense Attaché Colonel Nigel Cliffe, Manager of the New Zealand Aid Programme Hannah Walton-France, Market Manager of Immigration of New Zealand Penelope Ann Chitty, and Policy Adviser Kristoffer Rada.

Next was Phoxay Khaykhamphithoune of the Lao People’s Democratic Republic, who was accompanied by his spouse Souddavone Khaykhamphithoune, Second Secretary Phoungern Soukvilai, and Third Secretary Aksonsavanh Sihabandith.

From the Kingdom of Saudi Arabia, Abdullah Bin Nasser Al-Basiri presented his credentials to President Aquino. With him were Chargé d’ Affaires Ishaq Ibrahim Aloraini, First Secretary Ayman Abdulghani Bedaiwi, and Second Secretary Fahad Eid Alrshidy.

Last was Thanatip Upatising from the Kingdom of Thailand, who was accompanied by his wife Monthip Upatising, Defense and Air Force Attaché Group Captain Washirask Poosit, Minister Counselor and Consul Somjai Taphaopong, and First Secretary Sirimon Atipatya.

United Nations, International Organization for Migration laud Philippines' willingness to help refugees
 
The United Nations High Commissioner for Refugees (UNHCR) and the International Organization for Migration (IOM) have thanked the Philippine government for its willingness to support migrants and refugees from Bangladesh and Myanmar currently stranded in the Andaman Sea and the Straits of Malacca.

“We welcome (Justice) Secretary de Lima’s declaration and are reassured that the right to asylum will be upheld. The Philippines has a strong humanitarian tradition of international protection in support of voiceless refugees. UNHCR is asking countries in Southeast Asia to approach this as a regional issue with real human consequences. It has been engaging governments in the region on the growing problem of irregular maritime movements," UNHCR Representative in the Philippines, Bernard Kerblat, said.

During her meeting with Kerblat on Tuesday, Justice Secretary Leila de Lima proposed that the Philippines and other member states of the Association of Southeast Asian Nations (ASEAN) send ships to rescue the boat people.

The IOM’s Chief of Mission in the Philippines, Marco Boasso, also commended the Philippines, saying, "It is very clear that these people are in need of humanitarian assistance from the international community and governments in the region. IOM is ready to support the Government of the Philippines and our humanitarian partners in finding sustainable solutions for this group."

The heads of the UNHCR and IOM, the UN High Commissioner for Human Rights, and the Special Representative of the UN Secretary General for Migration and Development have issued a joint statement calling on governments in the Southeast Asian region and the international community to help the stranded migrants.

Meanwhile, Communication Secretary Herminio Coloma, Jr. on Thursday reaffirmed the Philippine government’s commitment to provide humanitarian succor and relief as a signatory to the UN conventions relating to refugees and stateless persons.

“We are mindful that we are constrained by resource limitations, especially considering that we are still in the midst of implementing a massive rehabilitation and reconstruction program for areas affected by Typhoon Yolanda,” Coloma said.

He said the Philippines’ commitment was concretely demonstrated through its cooperation with the UN in establishing the Philippine Refugee Processing Center in Morong, Bataan in 1980, which operated until the mid-1990’s.

The Center, with funding from the UNHCR and support from various international aid agencies, assisted refugees from Vietnam, Cambodia and Laos in seeking admission to resettlement nations such as the United States, Canada, Norway and France.

“We are in continuing dialogue with the local office of the UNHCR on how the Philippines may be able to meaningfully fulfill its commitment to the attainment of the UN’s humanitarian objectives,” Coloma said.

The Philippines is a signatory to the 1951 Convention Relating to the Status of Refugees and the 1954 Convention Relating to the Status of Stateless Persons.

Thousands of migrants and refugees are currently stranded on smugglers’ boats in the Andaman Sea and Straits of Malacca. Some are being held captive by smugglers demanding ransoms from their families, while others were left by their crews with little food and water following Thailand's crackdown on human trafficking. Critics free to question legality of Bangsamoro draft law, says Palace
 
A Palace official on Thursday said those against the passage of the Bangsamoro Basic Law (BBL) are free to challenge its legality before the Supreme Court.

Communications Secretary Herminio Coloma, Jr. said all the provisions in the proposed law have been scrutinized and carefully studied to follow the provisions of the Constitution.

“Simula sa pagbubuo nitong BBL ay isinaalang-alang na ang bawat probisyon nito ay dapat tumalima sa Saligang Batas,” Secretary Coloma said during a press briefing.

The House of Representatives ad hoc committee has approved the proposed law on Wednesday but a draft Senate report said the BBL requires Charter change.

Senator Miriam Santiago has also issued a statement saying the BBL will face legal challenge.

“Mahalaga na ang lahat ng probisyon ng Bangsamoro Basic Law ay tumatalima sa Saligang Batas. Nasa pagpapasya ng buong Kamara at ng buong Senado ang pagpasa sa BBL. Ayon sa proseso ng ating batas, kung mayroong nais kumuwestiyon sa legalidad pagkatapos maipasa ang isang batas, may pagkakataon silang ihain ang kanilang petisyon sa Korte Suprema,” said Coloma. APEC member economies must liberalize to sustain economic growth, says official
 
The Philippines and other member economies of the Asia-Pacific Economic Cooperation (APEC) must be ready to liberalize because they cannot afford to be left behind in a rapidly globalizing world, a foreign affairs official has said.

In a press conference on Thursday, Foreign Affairs Undersecretary Laura del Rosario was asked about the Philippines’ readiness for free trade in the Asia-Pacific region.

"I think (the Philippines is) as ready as the average APEC member because if you look at the TPP (Trans-Pacific Partnership), there are 12 members. We are 21 (in the APEC), that means nine are not there. But even among the 12, there a couple, two or three of them, who say that they see the negotiations as challenging to them because they have to do some domestic law changes," said del Rosario, who chairs the APEC 2015 Senior Officials’ Meeting (SOM).

Citing an example, she said Vietnam and Malaysia have to do their respective legislative changes to cope with liberalization.

“It is not how ready you are or how not ready are you. Definitely, for me whether you go into TPP or not, you have to be ready somehow, because at the rate things are changing in the economic world, you cannot afford not to be ready," she said.

Every economy must be ready because even if an economy is not a member of the Free Trade Area of the Asia Pacific (FTAAP), being unprepared would mean less investment, even less jobs, coming in, del Rosario explained.

Corporations with huge pools of money are not going to invest in an economy because they want to extend help, instead they want to make profit, she noted, adding that they want to go into an economy that is very efficient, where doing business is easy, and the cost of doing business is low.

Those are the objectives of the APEC so economies can make things easier for businesses and investors, ensure less choke points and have the right human capital to produce what they want, she said.

"And if we have those processes, definitely, we will attract these people," she added.

Asia-Pacific leaders who met in China last year agreed to move toward a new free trade zone strongly backed by Beijing. They agreed to launch a study on the FTAAP.

The Department of Social Welfare and Development (DSWD) has deployed more than 20,000 field staff nationwide to kick-off the 2nd round of assessment of the Listahanan or the National Household Targeting System for Poverty Reduction (NHTS-PR).

Listahanan is an information management system that identifies who and where the poor are. It makes available to national government agencies and other social protection stakeholders a socio-economic database as basis for identifying beneficiaries of their programs and services.

These field staff have been assigned to collect data from families using the traditional paper and pen in rural barangays all over the country.

“We prioritized remote and hard-to-reach areas to ensure that its residents will be included in the database and given an opportunity to benefit from a social protection program or service,” stated DSWD Secretary Corazon Juliano-Soliman.

All households in rural areas will be enumerated, while assessment in urban areas will be done in pockets of poverty or areas in the barangay where clusters of poor reside. Field staff who will be assigned in these areas will use a mobile device as data collection tool.

Around 27,000 more field staff will be trained and deployed to complete the assessment of 15.3 million households within 11 months.

“Results of this assessment will provide the department an update on the poor households who were identified in the 1st assessment,” Secretary Soliman said.

It may be recalled that in 2009, the DSWD conducted the first assessment which resulted to the identification of 5.2 million poor households out of the 10.9 million assessed.

These households have since become beneficiaries of the Philhealth Indigent Program. Some 4.4 million households have also been enrolled in the Pantawid Pamilya program.

Households are asked to cooperate in the assessment by providing true and accurate information to the enumerators. They may also send their complaints to the DSWD hotline number 0918-9122813 if they have observed irregularities in the conduct of the assessment.

BSP: Old banknotes good for daily transactions up to December 31, 2015

The Bangko Sentral ng Pilipinas Deputy Governor Diwa C. Guinigundo today reminded the public that the old banknote series launched in 1985 can still be used for daily transactions up to December 31, 2015.

From January 1, 2016 up to December 31, 2016, the old banknotes can still be exchanged in authorized agent banks and the BSP Cash Department. However, starting January 1, 2017, the old banknote series will be fully demonetized or without monetary value.

This means that the New Generation Banknotes introduced in December 2010 will result in the circulation of a single currency series in the country. The New Generation Banknotes have more and enhanced security features to protect the safety of the public against counterfeiters.

The demonetization process of the old banknotes is in line with the provisions of Section 57 of Republic Act No. 7653, otherwise known as the New Central Bank Act, which authorizes the BSP to replace banknotes that are more than 5 years old. The old banknotes have been in circulation for almost three decades.

The public is advised of the following important information:

1. The public may continue to use the old banknotes up to 31 December 2015 in paying and buying of goods and services and other business or financial transactions requiring the use of cash. Thereafter, these old banknotes will no longer be accepted for payment transactions;

2. From 1 January 2015 to 31 December 2016, the public may exchange with authorized financial institutions, namely universal and commercial banks, thrift banks, and rural as well as cooperative banks, their old banknotes with the New Generation Currency (NGC) Series at full face value, without charge.The public may also opt to exchange their old banknotes with the BSP or any of its regional offices/branches around the Philippines.

3. Government institutions holding old banknotes in which could not be exchanged during the prescribed period, such as banknotes used as evidence in a litigation case, will have to request the BSP Cash Department in writing, within the period of exchange, for a special exchange arrangement;

4. For Overseas Filipinos (OFs) abroad, who have in their possession old banknotes which could not be exchanged within the prescribed period, they may register online starting 1 October 2016 to 31 December 2016 through the BSP Website. These old banknotes may be exchanged with the BSP within one (1) year from date of registration; and

5. Starting 1 January 2017, NDS banknotes that have not been exchanged shall no longer have any monetary value, and are considered demonetized.

The Banking Industry Tripartite Council (BITC), led by Bangko Sentral ng Pilipinas (BSP) Governor Amando M. Tetangco, Jr. [center] and Department of Labor and Employment (DOLE) Secretary Rosalinda Dimapilis-Baldoz [third from left], yesterday has signed four new resolutions that further enhance labor-management relations in the Philippine banking industry. The Vice President is not immune from suit. He is an impeachable official but he is not immune from suit. Among the impeachable officials, only the President is immune from suit. Impeachability only means that he cannot be removed from public office except by impeachment. Any suit filed against him that would not result in his removal from office, like a civil suit for forfeiture of ill-gotten wealth, is allowed.

In jurisprudence, only the President, the State, and members of the diplomatic corps under international law, are immune from suit, for respective reasons. In the case of the President, he has to be protected from suits in order for him to concentrate on the business of running the government. He cannot be left attending to personal law suits left and right, instead of performing his job as the President. The State is immune from suit, and cannot be sued without its consent, under the principle that there can be no right against that which is the source of said right. Diplomats cannot be sued under the doctrine in international law that foreign envoys remain to be under the jurisdiction of their governments, not of the receiving state. This is a reciprocal privilege that is observed among countries with diplomatic relations with each other.

There is no doctrine in constitutional or political law that serves as a legal basis or rationale for immunity from suit of impeachable officials, other than for the President.

VP Binay is not the President, the State, or a member of the diplomatic corps representing a foreign state or government in the Philippines. Atty. Roque cites the case of former President Arroyo where he was prevented from filing a case for human rights violations against her. Precisely, President Arroyo was then the President. VP Binay is not the President.

Under the AMLA, the AMLC is authorized to file petitions for a freeze order or bank inquiry before the CA. In the case of a freeze order, the same shall be lifted if no case is eventually filed against the person who is the subject of the freeze order. The case to be filed need not be a criminal case for money-laundering. It can be a civil case for forfeiture of ill-gotten wealth, which is independent of a prosecution for a criminal case of money-laundering or its predicate crimes, such as plunder, graft and corruption, and malversation. According to Section 27 of the Rules of Procedure for Civil Forfeiture (A.M. No. 05-11-04-SC), "no prior criminal charge, pendency of or conviction for an unlawful activity or money laundering offense is necessary for the commencement or the resolution of a petition for civil forfeiture". In a civil forfeiture case, the degree of proof needed is only preponderance of evidence, not guilt beyond reasonable doubt.

After the freeze order and further examination of VP Binay's, and his relatives' and dummies' bank accounts, the AMLC can file a civil case for forfeiture of ill-gotten wealth through the Solicitor General. The filing, trial, hearing and decision in said case will not violate his impeachability since this civil case will only result in the forfeiture of his alleged ill-gotten wealth, not his removal from office.

In times of disaster, radiocommunication becomes instrumental in delivering crucial news vital to the survival of families and communities.

Aside from being utilized as a tool to deliver vital messages across communities, radiocommunication also serves an outlet for normal community messaging and activities such as local sports, community events, special events, and local business advertising. As such, proper management is needed to ensure that radiocommunication is used to its fullest potential.

That said, the International Telecommunication Union shall conduct its Regional Radiocommunication Seminar 2015 and Workshop on Satellite Coordination for Asia-Pacific (RSS-15-Asia-Pacific) from the 25th to the 30th of May, with the participation of the Asia-Pacific Telecommunity (APT), and the Department of Communications, Government of Australia.

The 6-day event shall cover various topics concerning spectrum management which will include the correct procedures pertaining to the recording of frequency assignment in the Master International Frequency Register (MIFR), a review of the modifications to the ITU Radio Regulations (RR) and WR Resolutions that were agreed upon during the previous World Radio Conference (WRC-12), the Radiocommunication Assembly (RA-12), as well as the upcoming WRC-15 agenda. The current regulatory framework for international frequency management and the ITU-R Recommendations and best practices shall also be focused.

Over the succeeding days, the event shall conduct workshops on Terrestrial Services, a Regional Workshop on Satellite Coordination, wherein participants get the chance to experience the actual procedures of ITU notification, apart from software and electronic publications, all made available by the Radiocommunication Bureau to the Administration of Member States and to the ITU Sector Members; The RRS-15-Asia shall end with a Forum on “Space Planned Services: Current Status and Challenges” with the assistance of various regulators, operators, and other industry experts to offer a multidisciplinary take on the regulation, commercial, and technical aspects, as well as the future of such services in the region.

The Radiocommunication Bureau (BR) organizes world seminars on spectrum management in Geneva every two years. Administrations that are interested in hosting a regional seminar may contact the BR and, subject to availability of time and resources, the BR undertakes all the necessary steps to organize the event. Such seminars provide member states the necessary knowledge and understanding about spectrum management. The BR gives priority to developing countries and member states that have joined the Union.

Regional IPP Roadshow to start 22 May

The Board of Investments (BOI) will conduct an Investments Priorities Plan (IPP) Regional Roadshow in several key cities in the country starting on 22 May in General Santos City.

The IPP Roadshow is an agency initiative to bring its services to the regions by informing the public on the salient features of the IPP 2014-2016 and its implementing guidelines, specifically on the investment opportunities for potential and existing investors.

The IPP is a fundamental investment policy tool for industry development, which aims to build industries not necessarily through incentives, but through policy interventions and initiatives. The IPP targets investment opportunities and needs to create jobs, expand industries’ capacity and enhance the competitiveness of local industries.

Kentex fire victims may claim EC benefits, get livelihood assistance from DOLE

The victims of the fire disaster that razed Kentex Manufacturing Corporation in Valenzuela City may claim employee compensation benefits even if they are not enrolled with the Social Security System (SSS), Labor and Employment Secretary Rosalinda Dimapilis-Baldoz yesterday said.

Baldoz issued the statement following the DOLE’s probe on the occupational safety and health and general labor standards aspects of the fire accident involving the rubber slipper manufacturer which claimed the lives of 72 workers.

“I assure the worker-victims that as long as there is an employer-employee relationship, a worker can file an employees' compensation claim from any SSS branch,” Baldoz said, calling on all Kentex Manufacturing Corporation employee-workers who survived the blaze to come out in the open and visit the DOLE office in CAMANAVA located at 5th Floor Araneta Square Center, Monumento Circle, Caloocan City, and register their names as Kentex employees.

Employees Compensation Commission (ECC) Executive Director Stella Banawis confirmed this, saying that even if the worker-victims were not SSS members, they can still file claims under the Employees’ Compensation Program.

Yesterday, Executive Director Banawis said the ECC’s Quick Response Team has visited 15 families of the fire victims to condole with the families and console them, inform them about their ECC benefits, and instruct them on how to claim these benefits. Members of the team also distributed grocery bags to the families.

“We also have personnel at the one-stop shop set up by the Valenzuela City local government unit to dialogue with the families and entertain their queries,” she said.

Earlier, Secretary Baldoz has instructed Executive Director Banawis to dispatch an ECC Quick Response Team to families of the workers who died during the fire incident to assist them in the filing and claiming of their EC benefits.

A coordinating mechanism is in place in the DOLE-NCR as to the granting of livelihood training and assistance for the survivors of the blaze.

The other day, DOLE-NCR Alex Avila informed some worker-survivors whom he invited to a dialogue that the DOLE could offer them livelihood grants, if they want, provided they could identify and determine the possible livelihood undertaking and submit a proposal.

6-KM tourism road completed for Agusan del Norte

A recently completed road improvement project of the Department of Public Works and Highways (DPWH) will give extra boost to the tourism industry of Agusan del Norte.

The 6.8 kilometer upgrading project of NRJ Tagcatong-Vinapor Road in the municipality of Carmen provides better road access for tourists bound to Jurassic Beach Resort, Bolihon Beach and the unspoiled Diwata Cave.

Funded under the 2014 Department of Tourism-DPWH Convergence Program in the amount of P133 million, the project includes the 6.10 meter width of road concreting using Portland Cement Concrete Pavement (PCCP), with 1.5 meter width of paved shoulder on both sides at intermittent sections and provision of cross drains and line canal.

“Our objective is to transform Agusan del Norte and other provinces of Mindanao designated by DOT as tourist attractions through the development of quality road network,” said DPWH Secretary Rogelio L. Singson.

“Investing in tourism infrastructure in Mindanao is one of the top priorities of the government. This would translate to economic development of the area, with the increase in demand for goods and services,” added Secretary Singson.

The Criminal Investigation and Detection Group (CIDG) launched its “ONE-TIME-BIG-TIME” (OTBT) nationwide operations against syndicated criminal gangs, wanted criminals and loose firearms (FAs) from May 11-18, 2015.

CIDG Director, PDIR BENJAMIN B MAGALONG said that these “OTBT” operations were part of the Philippine National Police’s “Operations Plan (OPLAN) LAMBAT SIBAT” which is in accordance to Secretary of Interior and Local Government Mar Roxas’ anti-criminality campaign that took place since mid of 2014.

During these operations, the Team CIDG were able to execute forty-eight (48) search warrants (SW), nabbed sixty-three (63) personalities, and recovered ninety-one (91) firearms, 1195 explosives and ammunitions worth Php1,489,946.00 (street value) of illegal drugs and other seized items.

In Region 1 CIDG, several operations were conducted against members of criminal groups including the conduct of separate operations against Alwin Acosta and Servillano Aquino in Barangay Tabtabagan, Banna and Barangay Albano, Dingras, Ilocos Norte, respectively. Both Acosta and Aquino were members of the “ABROGENA Group” engaged in illegal drug trade and gun-for-hire activities in the Provinces of Ilocos Norte. Seized from their residences were assorted FAs and ammunition, hand grenade, drugs and drug paraphernalia.

In Pangasinan, two (2) operations were made by the detectives of 1RCIDG against two (2) known criminal groups involved in illegal drug activities. One operation was during the implementation of SW against Antonio Santos and Carlito Santos in Barangay Sapang, Sta. Barbara, Pangasinan which resulted to the seizure of FAs and ammunition.

According to PSSUPT FRANCISCO ESGUERRA, Regional Chief of 1RCIDG, the arrested, Carlito Santos is the leader of the “SANTOS Criminal Gang”, a group engaged not only in illegal drug activities but in gun-for-hire and robbery activities in 2nd, 3rd and 4th districts of Pangasinan as well.

Another operation was in Barangay Telbang, Bayombong that resulted in the arrest of Bernardo De Vera y Payomo who is affiliated with the “DE VERA Group” involved in illegal drug activities operating in the 3rd district of Pangasinan. Confiscated from him was one (1) unit of cal. 9mm, magazine & ammunition.


The Team CIDG in Region 3 headed by PSSUPT ISMAEL FERNANDEZ were able to conduct operations in Nueva Ecija, Bataan and Olongapo resulted in the apprehension of Prudencio Francisco Sr, Sonny Dela Cruz, Leo Enriquez and Angelito Guanzon. Confiscated during these operations were six (6) FAs in different calibres, ammunition, explosives, FAs accessories, four (4) sachets of suspected shabu and drug paraphernalia.

The 4A-Regional CIDG served five (5) search warrants in various provinces in the Region. These operations caused the arrest of six (6) personalities and seizure of various FAs, ammunition and explosive, and Php2,500.00 worth (street value) of illegal drugs.

One of the arrested personalities is Victor Arevalo, a newly identified member of the “SALVADOR MENDOZA Group” who is believe to be engaged in illegal drugs and gun-for-hire activities in Batangas.

Another arrested person, Gilbert Mayo, is a member of the “TASWENG Robbery/Hold-up Group”. In the operation conducted by 4B-Regional CIDG, the detectives implemented a SW in Sablayan, Mindoro Occidental against Eldie Pines and Randy Benedicto resulting to their apprehension and confiscation of one (1) CZ 9mm pistol, magazines and ammo. Both Pines and Benedicto are members of a criminal group involved in gun-for-hire, gun running and robbery/hold-up activities in the province.

Team CIDG in Region 5 conducted eight (8) operations and arrested seven (7) personalities, seizure of nine (9) FAs, an explosive, ammunition, and a total of Php300,000.00 worth (street value) of illegal drugs.

One arrested personality was Joel Ortega, an active member of a newly identified criminal gang known as the “ALLAN SOL Criminal Gang” who is engaged in illegal drugs activities in Labo, Camarines Norte. Manuel Refil Jr, arrested in Mandaon, Masbate is a member of the “REFIL Gang” involved in gun-running. Another arrested person in the name of Franco Oliquino in Pio Duran, Albay, is the leader of the “OLIQUINO/CASTOR Robbery Group”.

During the buy-bust operation in Villa Caceres Hotel, Magsaysay Avenue, Naga City, the 5RCIDG detectives were able apprehend Romeo Reconday who is allegedly included in the Pili, Camarines Sur Drug Watch List and also a member of the “BULAO Drug Syndicate” operating in Naga City, Pili, and San Fernando.

5RCIDG’s recent operation was launched last May 17, 2015 in Purok Maligaya, Barangay Guinbanwahan Balud, Masbate against Edgardo Alajar (arrested), who is said to be a member of “ALAJAR Gang”, a newly identified gang involved in gun-running activities.

In the Visayas Region, on May 17, 2015, Reynaldo Villaruel was arrested during the buy-bust operation by CIDG Region 6 operatives in Barangay Ginhalaran, Silay. Seized from the Villaruel were two (2) calibre 45 pistol with magazine and three (3) Php500.00 bill marked money.

In Cebu City, the Team CIDG Region 7 detectives led by PSSUPT RITCHIE POSADAS, RC of 7RCIDG conducted seven (7) operations and arrested five (5) persons. The team recovered twenty-four (24) high and low-powered FAs, explosive, ammunition, drug paraphernalia and a total of forty-seven (47) sachets of suspected shabu with a street value of Php635,000.00.

Arrested during these said operations were Edgar Padillo, Ernesto Mamalias, Samuel Villanueva, Dexter Pasaje, and Razilyn Rosalinda Tecson.

The three (3) SWs were served by the 8RCIDG detectives led by PSupt Bowenn Masauding, in various cities in Leyte that caused for the apprehension of six (6) persons namely, Joel Go, Rodrigo Aure, Arnel Baldivino, Elmer Garciano, Danilo Aynaga, and Joel Melado. The detectives seized twenty-four (24) assorted FAs, live ammunitions, drug paraphernalia, eight (8) sachets of suspected shabu, gambling paraphernalia, and Php4,615.00 worth of bet money.

Western Mindanao, a CIDG Region 9 Team together with Dinas MPS and PAIDSOTF have implemented a SW against the members of “AMMBOL Group”, Nasroden Belonio Mayo and Seddik Solaiman Bugat at Barangay Binoatan, Dinas, Zamboanga Del Sur. Both were arrested and confiscated in their custody were six (6) sachets of shabu, drug paraphernalia, & ammunition.

Northern Mindanao, CIDG Region 9 Team conducted eight (8) operations and was able to arrest nine (9) personalities, recovery of twelve (12) FAs, three (3) explosives, 220 ammunitions, one (1) sachet of shabu with a street value of Php1,000.00.

One notable operation of the CIDG Northern Mindanao was the apprehension of Mohamad Ali, Raul Ganihay alias “Commander Round”, Brgy Kagawad Bryan Arcay and Kiram Ali on May 18, 2015 in Barangay Dagumbaan, Talakag, Bukidnon. Ganihay or “Commander Round” is the leader of the “TUN-ANANS Crime Gang” involved in cattle rustling, robbery in band and gun-for-hire activities.

Three (3) operations were conducted by the Eastern Mindanao CIDG detectives which led to the arrest of three (3) persons and the seizure of FAs with different calibres, ammunition and suspected shabu weighing to more or less 124 grams with a Php1,116,000.00 street value.

A noteworthy operations of the group were the buy-bust operation in Davao City against Satra Adih and Bryan Grant that resulted to the confiscation of 120 grams of shabu worth (street value) Php1,080,000.00 and 4 grams of shabu with a street value of Php36,000.00, respectively.

The Southern Mindanao CIDG was able to served two (2) SWs in South Cotabato and Sultan Kudarat that resulted to the recovery two (2) FAs, three (3) explosives, ammunition, drug paraphernalia, and 25 grams (approximately) of suspected shabu.

On May 12, 2015, the Team CIDG of Region 13 apprehended a certain Jose Roquito Jugao IV during the buy-bust operation in Imadejas, Butuan City.

Confiscated in Jugao’s possession were 5.97 grams (MOL) of shabu with street value of Php70,446.00, drug paraphernalia, Php7,340.00 amount of money, and Php1,000.00 bill marked money.

The North Central Luzon CIDG has served three (3) SWs in Benguet, Isabela, and Abra that resulted in the arrest of two (2) personalities identified as Jovita Castillo and Alfredo Bulos Flores. The team also seized four (4) FAs, magazines, an explosive, and one (1) sachet of suspected shabu.

Maguindanao, the CIDG Central Mindanao detective with RID-PROARMM and Upi MPS implemented a SW against Jimmy Mobantan, Arnold Mobantan and Maorijoy Mobantan (all at large) in Nuro Upi, Maguindanao and confiscated during the operation were one (1) calibre 30 carbine M2 rifle, two (2) calibre 45 pistol, eleven (11) magazines,& live ammunition .

These numbers of anti-criminality operations is an indication of Team CIDG’s heightened campaign to get hold of and prevent these lawless criminals in further damaging our communities, our families, and our lives. PDIR MAGALONG stressed out that he, alongside his dedicated men, will continue their efforts in seeking the truth, serving and protecting the country against those criminal elements.

Magalong added that all arrested suspects will be facing criminal charges for violation of RA 10591(Comprehensive Firearms and Ammunition Regulation Act ) and RA 9165 (Dangerous Drugs Act of 2002).

MANILA – Government of the Philippines (GPH) chief peace negotiator Prof. Miriam Coronel-Ferrer conveyed her appreciation to the members of the House of Representatives ad hoc committee on the Bangsamoro Basic Law (BBL) for exerting due diligence as they deliberated and voted on every section of the proposed measure, noting that substantive elements of the proposed law were retained in response to the call of the Bangsamoro people for genuine autonomy.

“We have been monitoring the proceedings in Congress since Monday and we definitely appreciate that our honorable representatives have exerted all efforts and and responded to the call of the people to draft a BBL consistent with the CAB (Comprehensive Agreement on the Bangsamoro) and in accordance to the 1987 Philippine Constitution,” she said as the ad hoc committee on the BBL approved the proposed law at the committee level today, May 20.

The line by line voting on the specific provisions on the proposed BBL started Monday afternoon, May 18. The lawmakers resumed their session early morning Tuesday and adjourned once more around 11 p.m. The Ad Hoc Committee continued its proceedings today for referral of the bill to the House committee on appropriations and the committee on ways and means before submission to plenary.

Substantive parts of BBL

According to Ferrer, the three most substantive elements of the BBL were carried in the amended draft of the ad hoc committee. “The important elements are still there, notably: the structure of government; automatic block grant; and the layered voting process where the majority vote in the six Lanao del Norte municipalities and 39 North Cotabato barangays shall be determined at the level of the local government unit.”

The chief peace negotiator added that most articles, especially on fiscal and economic matters were also preserved. “We are thankful that substantive parts and the spirit of the BBL to address the Bangsamoro aspiration for political and fiscal autonomy were heeded by our lawmakers in their voting on the provisions of the Bangsamoro law.”

During the two-day proceedings, the ad hoc committee has entrenched certain substantial changes to the bill such as the provision for the Chief Minister to have two deputies, one from the island provinces and another from central Mindanao; as well as the unequivocal recognition of the validity of the Indigenous Peoples' Rights Act (IPRA) in the Bangsamoro. The latter has allayed the anxiety of the Lumad communities who have been clamoring for the same.

“The welfare of the indigenous peoples has been enhanced. The same is true with the protection of women’s rights and welfare. While there were cutbacks on the jurisdiction of the Bangsamoro government over natural resources, the wealth-sharing from the exploration, development, and utilization of these resources were not changed,” continued Ferrer.

One step closer to BBL passage

Presidential Adviser on the Peace Process Teresita Quintos Deles hailed the passage of the BBL at the committee level, saying that “this is a good day in our quest for just and lasting peace as the draft BBL is one step closer to passage, having been approved on the committee level.”

DFA repatriates 17 Filipino fishermen from Indonesia

20 May 2015 - The Department of Foreign Affairs (DFA), in coordination with the Philippine Consulate General in Manado, repatriated yesterday, 17 Filipino fishermen of fishing vessels KM Garuda 05, KM Garuda 06, KM Inday Hubag, KM JVY and KM JV from Jakarta, Indonesia. They were received by Ambassador Ricardo M. Endaya of the Office of the Undersecretary for Migrant Workers Affairs (OUMWA).

The said 17 Filipino fishermen were arrested in groups for illegally fishing in Indonesian waters. They were not in possession of passports nor travel documents when they entered Indonesian waters. Of the 17, two are boat captains who served sentence after they were arrested in 2012.

DFA coordinated with the Department of Social Welfare and Development (DSWD) to arrange for the temporary shelter and transportation requirements of the said 17 Filipinos for their onward travel to General Santos City and Saranggani Province.

“The Philippine Government is committed to provide repatriation assistance to Filipinos who may find themselves in distress overseas, including our fisher folks who stray into foreign waters,” stated Ambassador Endaya.

Since January 2015, the DFA has repatriated 139 Filipino fishermen from Indonesia after entering Indonesian waters without proper documentation and permission.

20 May 2015 – A delegation composed of officials of the National Defense College of the Philippines (NDCP) and students of NDCP’s 50th Master in National Security Administration (MNSA) Program visited Norway from May 11 to 18. The 26-member delegation was led by NDCP President Dr. Fermin R. De Leon Jr., PhD, accompanied by his spouse, three NDCP officials, and 21 MNSA students composed of senior military officers, civilian government officials, select executives from the private sector, and allied officers from Nigeria and Sri Lanka.

The study visit is part of the MNSA Program’s Regional Security and Development Study (RSDS) component, wherein the students visit selected countries in a given region to provide an opportunity for them to interact with key officials and stakeholders in the focus area and identify important issues and lessons learned on development and national security. This year’s RSDS was conducted in Europe, with simultaneous visits of two other MNSA groups to Spain and Germany.

The NDCP group visited the Embassy to pay a courtesy call on Philippine Ambassador to Norway Bayani S. Mercado, and were briefed on the Embassy’s functions, coverage area, and important aspects of Philippines-Norway relations such as both countries’ long-standing tradition of maritime cooperation, Norway’s significant role in the peace process between the Philippine Government and the CPP-NPA-NDF, as well as with the Bangsamoro group, and bilateral trade and investments.

The delegation visited a total of seven Norwegian Ministries, namely, the Ministries of Defense, Trade, Industry and Fisheries, Foreign Affairs, Labor and Social Affairs, Local Government and Modernisation, Agriculture and Food, and Finance, their counterpart institution, the Norwegian National Defense College, as well as the Oslo City Hall. They were briefed on these agencies mandates and functions, and opportunities for cooperation were also explored.

Of particular interest to the group were the visits to the Defense Ministry, where they gained valuable insights on Norway’s defense and security policies and interests, and the visit to the Foreign Ministry, where a productive discussion on Norway’s foreign policy thrusts, Philippines-Norway bilateral relations, and Norway’s important role in the Philippine peace processes with the CPP-NPA-NDF and with the MILF were discussed.

Ph supports UNEP report on resource efficiency in Asia-Pacific

The Philippines supports a report of the United Nations Environment Programme (UNEP) that calls for more efficient use of resources and waste minimization among Asia-Pacific nations.

According to Environment Secretary Ramon J.P. Paje, the UNEP report could serve as an essential guide for governments and policymakers in the transition to low-carbon and resource-efficient economy.

Although the report notes a great potential for “green” growth, it warns that wasteful use of resources in Asia-Pacific countries is undermining their ability to sustain economic growth in the future.

Calling for a “new industrial revolution” to promote equitable human well-being with lower resource use, the report cautions that the region cannot depend on declining natural resource costs for its future growth.

The report says a more sustainable pathway is required for the region, but this shift needs financing – some US$2.5 trillion in annual sustainable development investments.

“These types of information are relevant for the Philippines and in other governments across the region in order for us to make the most informed decisions that best serve our people,” Paje pointed out.

He added: “This knowledge of current patterns of resource use can further help us make decisions about our policy priorities, development, and implementation towards a low-carbon, resource-efficient economy.”

Citing the report, UN Under-Secretary General and UNEP Executive Director Achim Steiner said that Asia-Pacific, known as the most diverse region in the world and home to 60 percent of the world’s population, “will be crucial to the success of the sustainable development, financing and climate change agendas being finalized this year.”

“The region’s remarkable economic progress has lifted millions out of poverty, but inequality persists, climate change continues to grow as a threat, and, as this report shows, wasteful resource use has seen the material footprint of the region triple between 1990 and 2010,” Steiner said.

“Significant scale-up in investments towards a green economy, coupled with sound regulatory frameworks and the mainstreaming of sustainability in national development planning processes, can ensure Asia Pacific’s impressive growth continues while safeguarding human well-being and natural resources, and reducing the future carbon emissions trajectory,” he added.

Driven by rising consumption linked to a growing population and middle class, the UNEP report states that Asia-Pacific’s use of materials including biomass, metals, industrial and construction minerals and fossil fuels, is growing at 5 percent annually, faster than the rest of the world.

The use of materials in the region increased yearly from 5.7 billion to 37 billion tons between 1970 and 2010, compared to global consumption of 70 billion tons in 2010.

Per capita material use increased fourfold from 2.3 tons to 9.3 tons over this period, the bulk of this growth happening after 1990.

It took an estimated 3 kilograms (kg) of materials to produce one dollar of Gross Domestic Product (GDP) in the region in 2010, compared to 1 kg for the rest of the world.

Developing Asia-Pacific countries needed 5 kg of materials to produce a dollar of GDP in 2010. This low efficiency points to the great potential to improve efficiency by which materials are used in the region.

For the first time, the report provides Asia-Pacific policy makers with estimates of national material footprints. These adjust national resource consumption to account for trade.

The material footprint of the region grew threefold between 1990 and 2010 with a maximum increase of 400 percent in the construction sector. Agriculture saw the smallest increase of 1.8 times in its material footprint during this period.

The region’s demand for electricity, gas and transport fuel, mainly met from coal and petroleum, has increased more than four times over the past 40 years, largely due to rapid urbanization in China.

However, per capita water use is declining in the region and is estimated at 544 m3 annually in the developing countries and 6893 in the industrialized countries. Agriculture is the main user, accounting for 80 per cent of water consumption.

The relative slow growth in the region’s share of global water use from 51 per cent in 1970 to 55 per cent in 2010 indicates improved water use efficiency.

Despite a fourfold increase in greenhouse gas (GHG) emissions in the region between 1970 and 2010, there has been a dramatic reduction in carbon intensity in Asia-Pacific developing countries, from nearly 10 kg CO2-eq per dollar to less than 3 kg CO2-eq per dollar over this period.

Otacan said a two-day CSF training/orientation and actual demonstration for tractor’ operators was conducted and attended by the Agrarian Reform Beneficiaries (ARBs) of RAMPUCO (Ramrod Multi-Purpose Cooperative) in Canlaon City, MAFACCO (Masulog Farmers Community Cooperative) in Canlaon City, SPFWMPC (Sycip Plantation Farm Workers Multi-Purpose Cooperative) in Manjuyod, KASFARBECO (Katacgahan Small Farmer Beneficiaries Cooperative) in Bais City, SUFARMPUCO (Samac United Farmers Multi-Purpose Cooperative) in Mabinay, SJARBC (San Julio Agrarian Reform Beneficiaries Cooperative) in Tanjay, LARBEMCO (Lapay Agrarian Reform Beneficiaries Multi-purpose Cooperative) in Bayawan, all in the province of Negros Oriental , and the ANARBA (Anonang Norte Agrarian Reform Beneficiaries Association) in Bogo City, Cebu.

DOJ sets preliminary investigation on estafa, criminal charges vs. LBC Bank stockholders and former officers on May 29

The Department of Justice (DOJ) will conduct preliminary investigation on the criminal complaint filed by the Philippine Deposit Insurance Corporation (PDIC) against eight former stockholders and officers of the closed LBC Development Bank (LBC Bank). The hearing is set on May 29, 2015. The PDIC, Receiver and Liquidator of the closed LBC Bank, filed the criminal complaint with the DOJ on April 29. LBC Bank is a 19-unit thrift bank ordered closed by the Monetary Board and placed under the receivership of the PDIC on September 9, 2011.

In the criminal complaint, PDIC charged LBC Bank stockholders Juan Carlos G. Araneta, Santiago G. Araneta, Fernando G. Araneta, and Monica G. Araneta and former LBC Bank officers Ma. Eliza G. Berenguer, Ofelia F. Cuevas, Arlan T. Jurado, Jennifer E. Cerrada with Estafa and Falsification of Commercial Documents under the Revised Penal Code and Conducting Business in an Unsafe and Unsound Manner under Section 21 (f) and (g) of Republic Act No. 3591, as amended.

The complaint alleged that LBC Bank officers fraudulently caused the issuance of LBC shares of stocks to Juan Carlos G. Araneta, Santiago G. Araneta, Fernando G. Araneta, and Monica G. Araneta in July 2008 and made it appear as if these stockholders infused P39.15 million to LBC Bank. However, allegedly, LBC Bank did not actually receive from the Aranetas the consideration for the stocks issued to them.

The PDIC further alleged that the respondents took advantage of their positions and connived to deceive regulators and the depositing public into believing that the bank had sufficient capital to continue operations. Depositors thus continued to entrust their money to the bank, resulting in the increase in deposits from P2.064 billion in 2004 to P6.094 billion in 2011 despite being capital deficient since 2004.

LBC Bank's extensive capital deficiency led to its closure in 2011 affecting more than 26,000 depositors, whose aggregate deposits of P6.1 billion took a toll on PDIC's Deposit Insurance Fund (DIF), the Corporation's main fund source for payout of insured deposits. The PDIC paid LBC Bank depositors P2.9 billion in insured deposits as of March 31, 2015. Uninsured deposits amounting to P2.7 billion involving 1,437 accounts shall be paid out of the bank's assets.

This is the second case that the PDIC has filed against LBC Bank officials. The first case resulted in the filing of a criminal case for estafa (Criminal Case No. 14-1092-1107) against former LBC Bank President Ma. Eliza G. Berenguer and a borrower of the bank, Benito Ramon V. Araneta before the Regional Trial Court of Makati City, Branch 143 for allegedly defrauding the bank in the amount of P229.5 million. The filing of charges against the LBC Bank officers is in support of PDIC's efforts to bring to justice parties that engage in acts that will put depositors and the DIF at risk. The PDIC continues to pursue legal actions against bank officials and personnel who engage in unsafe and unsound banking practices that pose grave threats to the stability of the country's banking system. The PDIC is mandated to generate, preserve, maintain faith and confidence in the country's banking system, and protect it from illegal schemes and machinations.

PhilHealth forges ties with PRA for the enrolment of foreign nationals

The Philippine Health Insurance Corporation (PhilHealth) will soon provide health care benefits to foreign nationals and former Filipinos who wish to retire in the country.

This development came about as it formally signed a Memorandum of Understanding (MoU) with the Philippine Retirement Authority in Pasig City.

Under the agreement, the PRA will facilitate the enrolment of foreign nationals under the Informal Economy member-category of PhilHealth.

The MoU aims to further strengthen the collaboration between the two agencies to promote the country as a retirement haven to qualified foreigners as support to PhilHealth’s thrust towards Kalusugang Pangakalahtan (KP).

“We intend to cover each and every Filipino, retiree man ‘yan o hindi, dayuhan man ‘yan o Pilipino... I think PRA will help us gain 100 percent coverage which is PhilHealth’s mandate,” said PhilHealth President and CEO Alexander A. Padilla.

PRA General Manager and CEO Veredigno P. Atienza, on the other hand, thanked PhilHealth for its support to help the agency attract more foreign nationals to permanently reside, retire and invest in the country.

PhilHealth and PRA are set to meet next month to establish a Technical Working Group that will work on the details of the agreement provisions that will form part of its Implementing Rules and Regulations.
